Will of Margaret Hayes In re MARGARET HAYES. DECEASED. This is the last will and testament of me Margaret Hayes, of St. John's in the Island of Newfoundland, Widow. I revoke all former wills by me at any time made, and I appoint my son John W, the Executor of this my will. I will and direct that my just debts and my funeral and testamentary expenses shall be first paid out of my Estate. It is my will and desire that, if possible to do so, my Executor shall pay and discharge all encumbrances on all my estate before making any of the divisions thereof which are hereinafter referred to, but if this be not in his power to do then and in such case I desire it to be understood that the bequest of any specific property shall, when such property is encumbered, to be a bequest of my equity of redemption therein CORRECT. (Listed in the Margin next to this will the following)

Note: The wills in those will books are NOT actual wills. They are hand-written copies of a, "last will and testament," written by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor. We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be. |
