Will of Margaret Hayes
from the Newfoundland will books volume 12 pages 392 & 393 probate year 1923

In re MARGARET HAYES.      DECEASED.

This is the last will and testament of me Margaret Hayes, of St. John's in the Island of Newfoundland, Widow. I revoke all former wills by me at any time made, and I appoint my son John W, the Executor of this my will. I will and direct that my just debts and my funeral and testamentary expenses shall be first paid out of my Estate. It is my will and desire that, if possible to do so, my Executor shall pay and discharge all encumbrances on all my estate before making any of the divisions thereof which are hereinafter referred to, but if this be not in his power to do then and in such case I desire it to be understood that the bequest of any specific property shall, when such property is encumbered, to be a bequest of my equity of redemption therein
I will and direct that as a first charge upon my estate my Executor shall set aside yearly for a period of five years the sum of One Hundred Dollars. After the said sum of Five Hundred Dollars has been reached I direct that this amount and a further sum of Twenty dollars per year during her lifetime shall be placed at the disposal of my daughter Alice (Known in religion as Sister Josephine) for such use as she may desire.
I give and bequeath to my daughter Annie Collins my house on Cochrane Street at present occupied by Starnger. I also give and bequeath to my said daughter my interest in the house on Gower Street occupied by Cronan. I also give and bequeath to my said daughter Annie my interest in the leasehold property occupied by Gushue. I give and bequeath my house on Cochrane Street occupied by Farndale to my said son John W.
I give and bequeath my interest in the leasehold property on Gower Street occupied by Lacey, Cole, and the Chinese Laundry to my said daughter Alice, known in religion as Sister Josephine.
All the rest and residue of my estate including in particular my land and houses on Wickford Street, Goodview Street, Lime Street, Carter's Hill or elsewhere I give and bequeath to my said son John W. and my said daughter Annie in equal shares between them as tenants in common. Save and except that I bequeath to my said son John W. In addition to the bequests above for his own use absolutely my house on Portugal cove Road at present occupied by Maunder.
In witness whereof I have hereunto subscribed my hand at St. John's aforesaid this thirteenth day of December in the year of Our Lord One thousand nine hundred and twenty two. MARGARET HAYES.
Signed published and declared by the Testatrix as and for her last will and testament in presence of us, both being present at the same time, who at her request and in her presence hereunto subscribe our names as witnesses attesting the due execution hereof:

Note: The wills in those will books are NOT actual wills. They are hand-written copies of a, "last will and testament," written by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor.

We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be.
