Last Will and Testament of
Rev. Moses Harvey of St. John's
Presbyterian Minister, deceased.

      I Moses Harvey, Presbyterian Minister of St. John's Newfoundland declare this to be my last will and testament, revoking all former wills. I appoint as my executors and Trustees my nephews James Monroe and Daniel Monroe, my grand-nephew Walter Monroe and my son Alfred J. Harvey.

I direct my executors and Trustees to invest the sum of four thousand five hundred dollars for the benefit of my youngest son Frederick Carson, which they are to hold in trust for him and pay him quarterly or half yearly the interest which may accrue from the same, the principal to remain intact. On the death of my son Frederick Carson I direct that this sum of four thousand five hundred dollars shall be divided into four equal parts: one to be paid to my grandson Charles Henry, if then living, or if not living, to his sisters Florence and Marion Emma; one to my daughter-in-law Jane Harvey or equally among her children should she not be then living; one to my son Alfred Joseph, or equally among his children, if not then living and a fourth equally among all my surviving grandchildren.

I direct that the sum of four thousand dollars be invested by my executors and Trustees and held in trust for the benefit of my grandson Charles Henry, son of my deceased son Charles James the interest accruing on which is to be paid quarterly or half yearly to his mother, or in case of her death to his guardian for his maintenance and education. I empower my Trustees to devote a portion of this sum of four thousand dollars should they think it desirable, to his maintenance at a university, should he choose a profession, or to aid him if he should enter on business in any way: the remainder to be paid to him on his becoming of age. If such an arrangements is not considered desirable the whole amount of four thousand dollars to be paid him on becoming of age. Should he die before coming of age his bequest of four thousand dollars to be divided in equal shares between his two sisters Florence and Marion Emma, my granddaughters on the marriage or becoming of age of either.

I direct my executors to invest the sum of one thousand dollars for the benefit of my granddaughter Eva, daughter of my son Alfred, to be held in trust by them, the interest on this sum to be paid quarterly or half yearly to her father for an aid to her education, and the principal to be paid to herself on her marriage or becoming of age. I empower my executors to use a part or the whole of this sum of one thousand dollars for her education if her father wishes it. In case of Eva's death before the expenditure of this sum, her share is to be paid to her sister Muriel.

I also direct my executors to invest the sum of five hundred dollars for the benefit of each of my two grand-daughters Florence Wood and Marion Emma Harvey, this sum of one thousand dollars to be held in trust by them, the interest to be paid to their mother, or in case of her death to their guardian to help in their maintenance and education: the principal to be paid to each of them on their marriage or becoming of age - Should one die before the other while under age the survivor to receive her share.

I bequeath the sum of five hundred dollars to my grand-daughter Muriel, daughter of my son Alfred to be paid to her father on my decease for her benefit.

I bequeath to my nephew John Brown Harvey the sum of three hundred dollars to be paid to him on my decease.

I bequeath to my brother Joseph resident near Armagh Ireland the sum of one hundred dollars to be paid to him on my decease.

I bequeath the remainder of my estate, which I estimate to be four thousand two hundred dollars, to my son Alfred Joseph to be paid to him on my decease I also bequeath to him my library to be disposed of by him as he may think proper. I also bequeath to him the silver tea and coffee service given me by the congregation of Free St. Andrews Church. I bequeath to my grandson Charles Henry my gold watch.

This will is written by my own hand, believing that this constitutes it a valid instrument and to it I now affix my signature on this eighth day of June 1900. (Sgd) Moses Harvey.

Codicil Dec. 27th 1900. I do not make any one a residuary legatee If there should be a surplus after all my debts are paid and all bequests provided for my executors will divide it equally between my sons Alfred and Frederick and Charles my Grandson (sgd) Moses Harvey

Codicil to my will made May 21st 1901. I hereby authorize my executors to pay Mrs. Jane Harvey a portion of the bequest of $500 each to her daughters which I have made, namely Florentine and Marion Emma provided she wishes to employ it for their education. I give my executors discretionary power in the matter, either to invest as directed in the body of the will or pay over a portion at once to their mother as their Guardian (sgd) Moses Harvey.

Codicil to my will made June 3rd 1901. I give full discretionary power to my executors to invest any sums of money left by me according to the best of their judgment, and should any losses be incurred they are not to be held responsible (sgd) Moses Harvey.

Codicil to my will made June 10th 1901. Should my assets not be found sufficient to pay all the bequests after all debts are paid then my executors are directed to make a proportionate reduction from each bequest to meet such deficit (sgd) Moses Harvey.

Codicil to my will made this 24th day of June 1901. I hereby cancel my bequest of five hundred dollars to my Grand-daughter Muriel Harvey (sgd) Moses Harvey.

Codicil to my will made this ninth day of July 1901. I hereby bequeath two hundred dollars to my daughter-in-law Jane Harvey (sgd) Moses Harvey.

Codicil to my will made this eighteenth day of July 1901. I hereby cancel the foregoing bequest of two hundred dollars to my daughter-in-law Jane Harvey. (Sgd) Moses Harvey.

Codicil to my will made on this 15th day of August 1901. I hereby direct that the interest on the bequest to my grandson Charles Henry shall not be paid to his mother as directed in the body of the will but to those who have charge of his support and general maintenance and education where he may be residing. If no part or a small part of it is required for his use then a part or all of it to go to his mother (sgd) Moses Harvey.

Codicil to my will made this 12th day of August I hereby cancel to bequest of three hundred dollars to my nephew John B. Harvey and substitute for it a bequest of two hundred dollars. (Sgd) Moses Harvey.

Codicil to my will made on this 22nd day of Aug. 1901 My executors are hereby directed to close the house No 3 Devon Row as soon after my death as they consider desirable having first disposed of the furniture and other contents of the house. (Sgd) Moses Harvey.

June 24th 1901 It is with much regret and reluctance that I have this day added a new codicil to my will cancelling my bequest of $500 to my Grand-daughter Muriel Harvey. I have done so solely from a fear lest increased expenditure likely to be incurred by the coming of Jane and possibly Charley might render it impossible for the executors to pay all the other bequests; but I entreat my executors if the estate allows it after all legacies are provided for and all debts paid, to pay over this bequest to my dear Muriel, either in whole or in part, as I am most anxious this should be done. They are to interpret the 1st codicil dated Dec. 27th 1900 in accordance with this codicil, or to set it aside entirely as to permit this to be carried into effect first then the other can also be carried out.

July 9th 1901 I have this day added to will bequeathing $200 to Jane Harvey my daughter-in-law It is for the purpose of helping to furnish her house in St. John's.
(Written sideways over the last two codicils, effectively marking them out, the following;)
I have cancelled this bequest I find after ?? job ?? to ?? house at fo???ut.

      I certify the foregoing to be a correct copy of the last will and Testament and codicils of Moses Harvey deceased
