Will of Josiah Harris
from the Newfoundland will books volume 10 pages 27 & 28 probate year 1913

In re Josiah Harris      deceased.

In the name of God Amen. I Josiah Harris fisherman of Seal Cove district of Trinity in the Island of Newfoundland do hereby mak my last will.

  • First I gave to my only son Elam my house and all household furniture and stable and all my land and all that I possess in the said mentioned place
  • Secondly my wife Johanna is to hold possession of all said property untill she changes her name
  • Thirdly the schooner that I hold with my brothers is to be sold and my part is to go to my family also cod trap and herring nets and all fishing materials my part also is to go to my family
  • Fourthly the land is to be shared and equally divided in three parts
  • Fifthly If my son should die before coming of age my wife can dispose of said property as best she likes

Note: The wills in those will books are NOT actual wills. They are hand-written copies of a, "last will and testament," written by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor.

We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be.
