from Newfoundland will books volume 4 pages 362 to 364 probate
year 1885
In re Israel Gosse deceased.
In the name of God Amen I Israel Gosse of Spaniards Bay Bishops Cove in Conception Bay Newfoundland dealer being of
perfect mind and memory of my body and knowing that it is appointed for all
men once to die do make and ordain this my last will and testament, that is
to say principally and first of all I give and recommend my soul into the hand
of Almighty God that gave it and my body I commend to the earth to be buried
in deasent Christian burial at the discrition of my executors namely my son
Stephen Gosse my son Josiah Gosse and my brother Moses
Gosse nothing doubting
but at the general resurrection I shall receive the same again by the mighty
power of God and as touching such worldly estate wherewith it hath pleased
God to bless me with in this life I give devise and dispose of the same in
the following manner and form
I give and bequeath to my dearly beloved wife Sarah Gosse all
my right title and interest in that land and property situated in Bishops Cove
bounded to the east by the Church yard fence and to the west by the late Jacob
Smith with all and every erection thereon with all my moveable property
together with all my money during her natural life but and immediately after
her death it shall be divided in manner laid down hereafter Also I give to my
son Moses Gosse all that land and property he now occupies in Spaniards Bay Northern
Cove together with half that property near Hickses house in Mint Cove Beach also
I give to my son Robert Gosse all that piece of land that he now occupies in
Mint Cove Spaniards Bay together with half that property near Hickses house in
Mint Cove Beach also I give to my son Stephen Gosse all the land and property
that he now occupies in Bishops Cove with half the fishing room and half the
stage and flakes also I give to my son Nathaniel Gosse half that piece of land
in Harbor Grace belonging to me next to Henry Gosses house say the north part
Also I give to my son Henry Gosse all that piece or parcel of
land situated in Harbor Grace with every erection thereon now in his possession
and I also give the other piece of land next to Henry Gosses house
to my son Henry
Gosse to be enjoyed by him and his lawfull heirs for ever also I give
to my my son Josiah Gosse immediately after his mothers death
all my land and property belonging to me that I now got in my possession both
moveable and immoveable with half the fishing room and half the stage and flakes
also I give to my daughter
Ann Smith all the land belonging to me at Main Beach north of Thomas
Maccarthy land say two gardens one at each side of main road also my
share of that land called the beach south of Mullenses fence extending toward
the Gut together with a small Island in the pond I give to my two daughters namely
Catherine Russel and Elizabeth Dobie to be
equally divided between them but in the event of Catherine Russel having
no child the land called Main
Beach given
to her by me shall after her death become the property of my son Stephen
Gosse and as to the money aforenamed I give to my son Stephen
Gosse the sum of fifty pounds to my son Josiah Gosse the sum of one
hundred pounds and the remaining balance after paying funeral expences with head
stones one for my self and one for my wife and all other necessary expenses it
shall be equally divide between my son Nathaniel Gosse and my three daughters
namely Ann Smith Catherine Russel and Elizabeth Dobie all the money to be paid
delivered and settled immediately after the death of my wife Sarah Gosse and
not before that time and this being my last will and testament
I do fully give and bequeath to my sons and daughters above named according
to this my will all the land and property and money allotted to them their heires
executors and assigns to be enjoyed by them for ever which said land shall not
be sold given or mortgaged to any person out of the name of Gosse and
I do hereby utterly disallow revoke and disannul all and every other former testament
will legacies bequaits and executors by me in any wise before named willed and
bequathied ratefying and confirming this and no other to be my last will and
testament in witness I hereby set my hand and seal this the tenth day of July
In the year of our Lord one thousand eight hundred and seventy six Signed sealed and delivered by the said Israel
Gosse as his last will and testament
in the presence of us who in his presence and in the presence of each other have
herewith subscribed our names, Israel Gosse (LS) Moses
Gosse, Nathaniel R. Gosse, Stephen Gosse.
whereas I Israel Gosse of Bishops Cove Conception Bay Newfoundland
Dealer have made and duly executed my last will and testament in writing bearing
date the tenth day of July in the year of our Lord one thousand eight hundred
and seventy six now I do hereby declare this present writing to be a codicil
to my said will and I do direct the same to be annexed thereto and to be taken
as a part thereof whereas I have given to my son Stephen Gosse the
sum of fifty pounds and to my son Josiah Gosse one hundred
pounds said sums now named in the body of my will I do now wish it to be finely
understood that if my wife Sarah
Gosse should come short and in want of money that she shall and may
draw so much of
Stephen Gosses fifty pounds and so much of Josiah
Goss is hundred as she may
reasonable require for her support drawing from each of them eaqual to what
I have left to them and I do hereby ratefy and confirm my said will in all
particulars thereof in witness whereof I the said Israel Gosse have
to this codicel set my hand and seal this the tenth day of July in the year
of our Lord one thousand eight hundred and seventy six, Israel

testator Israel
Gosse as and for a
codicil to be annexed to his last will and testament and to be taken as part
thereof in the presence of us Moses Gosse, Nathaniel R. Gosse, Stephen
Gosse.

Note: The wills in those will books are NOT actual wills. They are either hand-written copies or in later years typed copies of a, "last will and testament," written or typed by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation and also no paragraphs. The originals were kept by the executor. We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be. However, in some of the very long wills, we have tried to insert paragraphs to make it easier for the researcher to read the document. |
