The last Will and Testament of John Gorman late
of Kilbride Cross, near St. John’s, farmer, deceased.
This is the last will and testament of me John
Gorman of Kilbride Cross near St. John’s in the Island of Newfoundland farmer.
First I devise unto my two sons Edward and Michael the land and premises now
occupied by me in equal shares. Should my two sons Edward and Michael not be
able to live amicably in my said dwelling house, my said son Edward shall have
the right to eject my said son Michael and become sole possessor of the said
dwelling house, on paying my said son Michael the sum of sixty dollars.
Secondly. I give and bequeath unto my two sons Edward and Michael all the cattle
farming implements and household furniture on my premises.
Thirdly, my two sons Edward and Michael must support my two daughters Johanna
and Mary so long as it please my said daughters to live with them, and should
they at any time leave their home for the purpose of getting married or otherwise
my said two sons Edward and Michael must pay to each of them the sum of sixty
dollars in six annual instalments of ten dollars each and should my said son
Michael be living apart from my said son Edward for the reasons mentioned in
the first bequest herein he is still bound to contribute half the amount directed
to be paid my two daughters on leaving their present home but he is not bound
to contribute towards their support unless both them and him be living in the
said house.
Fourthly should my said two sons Michael and Edward refuse to support or discontinue
supporting my said two daughters Johanna and Mary or not pay them the amount
directed to be paid should they leave their home the aforementioned bequests
to my said sons are to be null and void, and any lands goods and effects of
every description are to be divided amongst sons and daughters in equal shares.
Fifthly. Should either of my said sons Michael and Edward refuse to support
or discontinue supporting my said two daughters Johanna and Mary or not pay
them his proportionate part of the amount directed to be paid them his share
shall be equally divided between my said two daughters. I hereby appoint James
Howlett executor of this my last will and testament. I hereby revoke all testamentary
dispositions heretofore made by me.
In witness whereof I have hereunto my hand subscribed at Kilbride Cross aforesaid
this twenty eighth day of July Anno Domini one thousand nine hundred and two.
John his x mark Gorman. Signed by the testator as and for
his last will and testament by making his mark (the same having been first
read over and explained) in the presence of us who in his presence at his request
and in the presence of each other have hereunto subscribed our names as witnesses
the words "or not pay "directed them the amounts directed
to be paid should they leave their home" having been first inserted on line
