Will of Philip George
from Newfoundland will books volume 9 pages 531-534 probate year 1912

In re
      Philip George          deceased.

      I Philip George of Southern cove, Hearts Content in the Electoral District of Trinity, being of sound mind, do by these presents make my last will and testament. I declare that I die as I have lived a faithful member of the English Branch of the Holy Catholic Church and do commend my soul into the safe keeping of my Lord and Saviour Jesus Christ trusting only to His merits for the Forgiveness of all my sins of omission or commission and for my hope of Everlasting Life.

A. I do give and bequeath my fishing schooner with all her gear and two cod-traps, two cod nets two herring nets, caplin seine, hawl gear etc to my three sons Theodore George, Bertram George and Noah George for their use absolutely. In the event of any or all of fishing schooner and property mentioned in this clause being sold the proceeds of such sale shall be divided into four equal shares one share of which shall be for my wife Harriet George the remaining three shares being given one share each to my three sons herein mentioned.

B I do give and bequeath the lumber mill with all machinery, timber cut and uncut, dams, water shoots, land around the mill owned by me to my three sons Theodore George, Bertram George and Noah George for their use. My son Joshua George is to be allowed the privilege of taking any lumber he requires for his own personal use to the mill to be cut as he may require free. In the event of the said mill machinery, land, or any portion thereof being sold the proceeds shall be divided into four equal shares one such share shall be given to my wife Harriet George the remaining three shares being given one share each to my three sons Bertram George Noah George and Theodore George.

C. I do give and bequeath my lands lying to the south of the Pipe Track to my sons Joshua George Bertram George and Noah George. In the event of such land or any portion thereof being taken for purposes of railway construction the money received shall be divided equally among my sons Joshua George, Bertram George and Noah George. The words “money received” shall be taken to mean money received as compensation through the arbitrators award.

D. I do give and bequeath my dwelling house with all that is therein to my wife Harriet George for her use as long as she lives or needs the same and at her decease or when she no longer needs the same to my son Noah George for his use absolutely.

E I do give and bequeath my stable, stores, old dwelling house, horse, carriage, carts, drays slides with all harness and other gear belonging thereto to my two sons Bertram George and Noah George with the condition that my son Theodore George shall be allowed the use of horse and gear on the same terms and conditions as during my life-time

F. I do give and bequeath the land and meadows around my dwelling house to my wife Harriet George and at her decease or when she no longer needs the use of same to my sons Bertram George and Noah George in equal shares. If at any time my wife Harriet George desires to make this equal division to my sons Bertram and Noah she shall have full power to do so.

G. I do give and bequeath my share in the waterside property to my sons Theodore George, Bertram George and Noah George and to their male heirs after them with this proviso that my son Joshua George is to have such use of it as he does during my life this privilege to die with him In witness whereof    signed - Philip his x mark George - The said Philip George affixed his signature or mark after the above had been read to him in our presence, in witness whereof we have made our signatures in his presence and the presence of each other this fifth day of October one thousand nine hundred and eleven     Arthur R. Anderson. Frank Smart.

I Philip George of Southern Cove Hearts Content in the electoral district of Trinity being of sound mind, do by these presents revoke the clause lettered C in my last will made and witnessed on the fifth day of October one thousand nine hundred and eleven and do substitute for it that which herein followeth I do give and bequeath my land lying to the the South of the Pipe track in equal shares to my wife Harriet George, my sons Theodore George, Joshua George, Bertram George and Noah George. In the event of such land or any portion of such land being taken for purposes of railway construction the money received shall be divided equally between my wife Harriet George, my sons Theodore George, Joshua George, Bertram George and Noah George The words “money received” shall be taken to mean the money received as compensation through the arbitrator’s award. In witness whereof signed - Philip his x mark George - The said Philip George affixed his mark after the above had been read over to him in our presence, in witness whereof we have made our signatures in his presence and the presence of each other this twenty - fifth day of January one thousand nine hundred and twelve Arthur R. Anderson M. B. Frank Smart. The cost of administration of this testament to be borne equally by my sons Theodore George Bertram George and Noah George. Signed - Philip his x mark George - This codicil was read over to Philip George and his mark was affixed in our presence in witness whereof we affix our signatures in his presence and the presence of each other    A.
