Last will and Testament of
John Garland of Pushthrough
Planter deceased

      This is the last will and Testament of me John Garland of Pushthrough, Hermitage Bay Newfoundland Planter. I hereby direct that at my decease all my funeral and testamentary expenses and all my just debts be first paid and settled. And after my death it is my desire that my wife Mary Garland shall hold possession of all my premises at Pushthrough including lands, houses, flakes, stage with all fishing skiffs, punts, nets and fishing gear together with all household furniture, beds & bedding and all other properties of every sort and description to be occupied used and enjoyed by her for her support and maintenance as long as she shall live. Also to receive the interest on all monies due to me or that may become due to me from any source whatever for her use and benefit as long as she lives.
And at her decease I do hereby give and bequeath unto my two sons James Garland and Wilson Garland conjointly the whole of my aforesaid premises at Pushthrough with all properties in and upon the same and all monies that may be due to me on current account by Messrs Newman & Co of Gaultois for their sole and absolute use and benefit for ever. And in case either of my two sons James Garland and Wilson Garland should die before my wife Mary Garland the whole of the above described premises to revert to the surviving son and in case they both should die before my wife Mary Garland, then at her decease the above described premises to be divided equally among my surviving children, beside which I give and bequeath unto my seven children viz:- William Garland of Laddle Island Elizabeth Roberts (formerly Garland) wife of Morgan Roberts of Pushthrough, Thomas Garland of Pushthrough Ann Roberts (formerly Garland) wife of John Roberts of Pushthrough, James Garland of Pushthrough, Maria Kendle (formerly Garland) wife of Thomas Kendle of Round Harbor and my son Wilson Garland of Pushthrough the sum of three hundred pounds sterling belonging to me now in the hands of Mesrs Newman Trust & Co. of the City of London England Merchants to be equally divided among them share and share alike for their sole and absolute use and benefit for ever and I hereby appoint Edward Clench Gallop Esq of Gaultois JP to be Executor of this my will
In witness whereof I have to this my last will and testament set my hand and seal this twenty third day of September in the year of our Lord one thousand eight hundred and eighty five. (Sgd) John his X mark Garland (LS) Signed Sealed and delivered by the Testator the said John Garland in the presence of us who in his presence at his request and in the presence of each other have hereunto subscribed our names as witnesses, it having first been read over and explained to him. Codicil

A Codicil to my will, the said will bearing date the twenty third day of September A.D. one thousand Eight hundred and eighty five. I hereby direct that owing to the decease of my daughter Elizabeth Roberts (formerly Garland) wife of Morgan Roberts that the amount bequeathed to her in my former will aforesaid be now equally divided between my other children viz William Garland, Thomas Garland, Ann Roberts (formerly Garland) James Garland, Maria Kendle (formerly Garland) and Wilson Garland. And I hereby appoint Edward Clench Gallop Esq Gaultois JP to be Executor of this my codicil. In witness whereof I have set my hand and seal this twenty second day of July in the year of our Lord one thousand eight hundred and ninety one. (Sgd) John his X mark Garland (LS) Signed Sealed and delivered by the testator the said John Garland in the presence of us who in his presence at his request and in the presence of each other have hereunto subscribed our names as witnesses it having first been read over and explained to him (Sgd) John W.       I certify the foregoing to be a correct copy of the last will and Testament and codicil of John Garland deceased
