Will of Alexander J. Garland, from Newfoundland will books volume 15 pages 149 & 150 probate year 1930

IN RE.                DECEASED

ALEXANDER J. GARLAND

I, Alexander J. Garland Sr, of Lower Island Cove, Conception Bay Newfoundland, a planter, being in an infirm state of body, but of sound mind and understanding, and knowning the uncertainty of human life, hereby declare this to be my last will, hereby revoking all wills hereto fore made by me.
After the payment of my just debts and funeral charges, I give, bequeath and devise as follows.

  1. To my wife Clara Garland, Long Shore Garden, for and during her natural life, and at the death of said Clara Garland, I give, bequeath and devise said Long Shore Garden to my son Alexander Garland Jr.
  2. To my son, William John Garland of said Lower Island Cove that portion of my land which is situated on the westerly side of the Main Line leading towards Lower Island Cove, Newfoundland, which is south of the Southern Road to Black Rock Brook, Newfoundland.
  3. To my daughter Sarah Elizabeth Goudie of Roslindale Mass U.S.A. that portion of my land which is situated on the westerly side of said Main Line which is North of the Southern Road to Black Rock Church Hole Brook aforesaid, and also that certain parcel of land which is situated at said Lower Island Cove, and extends southerly towards Bussey's land, the same being bounded by Bussey's land on outside Gully Hill Road, and on the north by Jacob Snelgrove's land, this letter bequest is to confirm the deed already given by me to my said daughter.
  4. To my said son, Alexander Garland, Jr, of said Lower Island Cove, that portion of my land which is situated on the easterly side of said Main Line which is south of said Southern Road; and also my fishing room, flakes, and the land connected therewith at said Lower Island Cove.
  5. To my daughter Selina Vail of said Lower Island Cove that portion of my land which is situated on the easterly side of said Main Line and is north of said Southern Road; and also one sewing machine.
  6. To my grandson, Frank W.H. Goudie of said Roslindale that certain parcel of my land which extends from Church Hole Brook to Little pond, and out to what is called Bussey's Hill, and also out to Black Rock Brook, aforesaid.
  7. To my grandson Frank Harvey Garland of said Lower Island Cove, my bed and bedding, after the death of his grandmother, my said wife, Clara Garland.
  8. To my son-in-law Hugley P. Goudie of said Roslindale a certain parcel of land at said Lower Island Cove, at a place called Canvas Town, said land being bounded easterly by the Old Main Line Road, Northerly and southerly by land now of late of William Commings, and extends on the south side to the wall.
  9. If my said son William John Garland, makes or causes any disturbances on any of said property, he shall be cut off from any share or portion of my estate.
  10. I nominate Samuel Garland, my nephew of St John's Newfoundland to be the executor of this will, and I request that he may be exempt from giving a surety or sureties on his bond as such executor.
  11. I hereby authorise and empower my said executor to sell at private or public sale, any part or all of my estate, real and personal, and to execute and deliver proper and sufficient deeds and instruments to convey and transfer same.

IN TESTIMONY WHEREOF I hereunto set my hand and seal and in the presence of three witnesses declare this to be my last will, this twenty-third day of April 1926 at Boston Massachusetts.

On this twenty third of April 1926 Alexander J. Garland Sr. of Lower Island Cove Conception Bay Newfoundland, signed the foregoing instrument in our presence, at Boston, Massachusetts, declaring it to be his last will, and as witnesses thereof, we three do now, at his request, in his presence and in the presence of each other, hereto subscribe our names.
