Will of Patrick Gardiner
from Newfoundland will books vol 11 page 441 probate year 1920

In re Patrick Gardiner       deceased

This is the last Will and Testament of me Patrick Gardiner of Saint John's in the Island of Newfoundland Fisherman.

  1. I appoint my son Ambrose Gardiner of Saint John's aforesaid Fisherman Executor of this my Will.
  2. I give and bequeath to my daughter Maud Brine wife of John Brine of Fortune Harbour Fisherman the sum of Seven hundred dollars.
  3. I give and bequeath to my daughter Christina Gardiner the sum of Seven hundred dollars which shall be in addition to the share of the residue of my estate hereinafter bequeathed to her.
  4. I give and bequeath to the Roman Catholic Episcopal Corporation of Saint John's in the following amounts viz:- fifty dollars for the use of the Roman Catholic Episcopal Corporation Grois Islands, and ten dollars for Masses for the repose of my soul.
  5. All the rest residue and remainder of my property estate and effect of every description I give and bequeath to my following named children share and share alike viz:-
    • [1] Mary Tobin wife of Patrick Tobin of Grois Island Fisherman.
    • [2] the said Ambrose Gardiner,
    • [3] Bernard Gardiner of Grois Islands,
    • [4] Francis Gardiner of Grois Islands Fisherman,
    • [5] Alfonsus Gardiner of Saint John's aforesaid and
    • [6] the said Christina Gardiner.

Witness my hand at Saint John's aforesaid this 3rd day of April Anno Domini one thousand nine hundred and twenty. Patrick Gardiner. Signed published and declared by the said Testator as and for his last Will and Testament in the presence of us who at his request in his presence and in the presence of each other [all present at the same time] have hereunto subscribed our names as witnesses. Note: The wills in those will books are NOT actual wills. They are hand-written copies of a, "last will and testament," written by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor.

We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be.
