Will of Denis Galway

Last Will and Testament of
Denis Galway of St. John's
Tailor deceased.

      This is the last will and Testament of me Denis Galway of St. John's in the Island of Newfoundland Tailor and Clothier. I devise and bequeath my two life policies of Insurance and all the money which shall or may arise therefrom unto my wife Bridget Galway for her sole use and benefit absolutely but as to the money standing in my name on current account in the Merchants Bank of Halifax, it shall be for the use of the business only.

I devise and bequeath the Thirty five shares which I hold in the St. John's Gas Light company and Five shares I hold in the St. John's Nail Manufacturing Company and all the real and personal estate whatsoever and wheresoever the same may be of which I shall be possessed at the time of my decease unto my said wife Bridget Galway so long as she shall live and remain my widow and no longer. After her decease or second marriage my children are to have and to hold the same share and share alike and I appoint my said wife Bridget Galway sole executrix of this my will hereby revoking all other testamentary writings and I authorize the said executrix of this my will or any other person or persons who may be hereafter lawfully appointed in her stead (should she from any cause whatever be unable to act as executrix as aforesaid) to sell any portion or part of my said real estate as shall be sufficient to satisfy a certain indenture of mortgage given by me upon that part of my real estate situate on Lemarchant Road and Water Street without being responsible for any loss occasioned thereby and for no other purpose whatever shall the authority herein given to sell be exercised.

In witness whereof I have hereunto subscribed and set my hand this ninth day of January A.D. one thousand eight hundred and ninety seven. (Sgd) Denis Galway. Signed by the said Testator Denis Galway as and for his last will and Testament in the presence of us who at his request and in his presence and in the presence of each other have subscribed our names as attesting witnesses (sgd) Michael Kiley. (Sgd) Jas. J. Collins Notary Public.

Codicil

This is a codicil to the last will and testament of me Denis Galway of St. John's in the Island of Newfoundland Tailor and Clothier Whereas I have by my said will devised all my real and personal estate unto my wife Bridget Galway so long as she shall live and remain my widow and no longer after her decease or second marriage my children are to have and to hold the same. Now I do by this my codicil to my said will revoke the said bequest and instead thereof do devise and bequeath all my real and personal estate as the same is already devise and bequeathed in and by my said will except nevertheless that after the decease or second marriage of my said wife Bridget Galway instead of the same being shared equally between my children as stated in my said will, my two sons Michael Galway and Denis Galway shall have and hold for their sole and absolute use and benefit for ever all that piece or parcel of land with the building now in course of erection thereon situate on the North side of Water Street in the town of St. John's aforesaid and adjoining the property of the late Edward Maher, my said son Denis Galway shall also have and hold for his sole and absolute use and benefit for ever all my farm on the Black Marsh Road.

My two said sons Michael Galway and Denis Galway are also to have an equal share with my other children of the residue of my real and personal estate whatsoever and wheresoever the same may be. In all other respects I confirm my said will. In witness whereof I have hereunto subscribed and set my hand this twenty seventh day of March A.D. one thousand eight hundred and ninety seven (sgd) Denis Galway. Signed by the said Denis Galway the testator as a codicil to his last will and Testament in our presence who at his request and in his presence and in the presence of each other at the same time have subscribed our names as attesting witnesses.
