Will of Johanna Funcheon

In the Supreme Court of Newfoundland

In the Estate of Johanna Funcheon Deceased.

I, Charles H Hutchings of St. Johns, in the Electoral District of St. John's East, make oath and say that Johanna Funcheon , late of St. Johns, in the Electoral District of St. Johns West widow deceased, died with a Will, that I and the Executor therein named; and I will well and faithfully administer the Estate and Effects of the Testatrix by paying her just debts and the Legacies contained in her Will so far as the same shall thereto extend and the Law bind me and by distributing the residue (if any) of the said Estate and Effects according to Law; that I will exhibit under oath a true, full and perfect Inventory of all and singular the Estate and Effects of the Testatrix, and render a just and true account thereof whenever required by Law so to do ; that the Testatrix died at St. John's aforesaid on the 2nd day of October, One Thousand Nine Hundred and Seven ; and that the gross value of the Estate and Effects of the said Testatrix is Fifteen Hundred Dollars, and no more according to the best of my knowledge, information and belief.

THIS IS THE LAST WILL AND TESTAMENT of me Johannah Funcheon of St. John's in the Island of Newfoundland, Widow, hereby revoking all former Wills and Testaments by me at any time made. First. I give and bequeath to my daughter Clara Quigley all my land and premises together with the buildings and erections thereon situate on the South West side of Pleasant Street bounded on the Southeast and Southwest by land of Bennett's estate and on the Northwest by land of one Summers. Second. I give and bequeath to my daughter Catherine Eagan subject to the payment by her of all my just debts funeral and testamentary expenses All that piece of land situate on the Northwest side of Cornwall Avenue, bounded on the Southwest by Bennetts estate, and also all that other piece of land situate on the South East side of the said Cornwall Avenue bounded on the Southwest and Southeast by Bennetts estate on the Northeast by land of Summers and Bastow and on the Northwest partly by Cornwall Avenue aforesaid and partly by land of Bastow. Third. I appoint Charles H. Hutchings of St. John's aforesaid, Kings Counsel, Executor hereto. IN WITNESS WHEREOF I have hereunto set my hand this Seventeenth day of July Anno Domini One thousand nine hundred and seven.

Signed by the said testator as and for her last Will and Testament in the presence of us, both being present at the same time, who at her request, in her presence and in the presence of each other have hereunto subscribed our names as witnesses.

I, Charles H Hutchings of St. Johns in the Electoral District of St Johns West in the Island of Newfoundland, Solicitor make oath and say that on the 17th day of July A.D. One Thousand Nine Hundred and Seven. I was presant and did see Johanna Funcheon late of St Johns in the Electoral District of St johns West in the Island aforesaid, Widow the testatrix named in the paper writing hereunto annexed, marked A, duly sign (by making her mark), publish and declare the said annexed paper writing, as and for her last Will and Testament in my presence, and in the presence of James P. Blackwood of St Johns Solicitor the other subscribing witness thereto. That I and said James P Blackwood then and there signed our names to such Will as such witnesses, in the presence of the said Testatrix. That previously to the said Will being so signed, as aforesaid, by the said Testatrix and the said witnesses, it was read over to, and approved of by, the said Testatrix in the presence of me and the said James P Blackwood. And that at the time of the said execution of the said Will, the said Testatrix was of sound and disposing mind, memory and understanding, to the best of my knowledge and belief.

TO THE HONOURABLE THE SUPREME COURT OR ONE OF THE HONOURABLE THE JUDGES THEREOF.

{something missing} Petition

of Catherine Eagan of S. John;s in the Island of Newfoundland, Married woman, Humbly shetheth:-

  1. That Johanna Funcheon, late of St. John;s aforesaid, Widow, died at that place on the 2nd. day of October instant, having made and published her last Will and Testament, which is hereto annexed marked "A", and of which she appointed Charles H. Hutchings of St. John's aforesaid, King's Counsel, Executor.
  2. That the said testatrix left her surviving as next of kin two daughters, namely Clara wife of John Quigley, and your petitioner.
  3. That the said testatrix was possessed at the time of her death of property of the probable value of $1500.00.
  4. Hereto annexed marked "B" is a just and true inventory of the assets of said deceasant at the time of her death.
  5. No Probate or administration is here granted to any Will or to the estate of said deceased.

Your petitioner therefor prays that Letter of Probate be granted to the said Charles H. Hutchings the Executor in the said Will named.
