Last will and Testament of
John W. Foran of St. John’s
Commission Merchant deceased

      This is the last will and Testament of me John W. Foran of St. John’s Commission Merchant.
First I hereby revoke cancel and disallow all former and other wills by me at any time made and declare this to be my true last will and Testament.
Second. I desire that all my just debts funeral and testamentary expenses shall be first paid out of my Estate
Third. I appoint my wife Margaret Foran and my friend the Honorable John Harris of St. John’s Merchant Executrix and Executor of this my will.
Fourth I give devise and bequeath to my said Executrix and executor all my estate lands goods chattels moneys property and effects of every description of which I shall die possessed upon trust to pay to my said wife Margaret Foran the yearly income thereof or arising therefrom for and during her natural life.
Fifth Upon the death of my said wife it is my wish and desire and I hereby will and direct that my said Executor shall hold the said estate land goods chattels moneys properties and effects in trust in the first place to pay out of the yearly income thereof to each of my three daughters Anna Mary, Margaret Bernard, and Elizabeth the yearly sum of five hundred dollars each during their natural lives and secondly to pay to my two sons Charles Joseph and Augustine Edward the remainder of the said yearly income of my said estate land goods chattels moneys properties and effects excepting the bequest hereinafter made to Catherine Power in equal shares between them for and during their natural lives.
Sixth. Upon the death of any of my said three daughters it is my wish and desire and I hereby will and direct that the annuity or yearly sum of five hundred dollars hereinbefore bequeathed to her shall be paid to the child or children of such deceased daughter. And that upon the death of any of my said daughters without issue surviving her it is my wish and desire and I hereby will and direct that the annuity or yearly sum of five hundred dollars hereinbefore bequeathed to such daughter shall be paid by my said executor to such of my children as shall then be living share and share alike. And upon the deaths of any of my said sons it is my wish and desire and I hereby will and direct that the bequest hereinbefore made to him shall be paid by my said Executor to the child or children of such deceased son and that upon the death of any of my said sons without issue surviving him it is my wish and desire and I hereby will and direct that the bequest herein before made to such deceased son shall be paid by my said Executor to such of my children as shall then be living share and share alike.
Seventh I hereby direct that my said Executor shall pay to my old servant Catherine Power out of my estate the yearly sum of fifty dollars for and during her natural life. Witness my hand at St. John’s this First day of December A.D. one thousand eight hundred and ninety seven. (Sgd) John W. Foran.     Signed Published and declared by the said testator as and for his last will and Testament in our presence who in the presence of the said testator and of each other, all present at the same time, have hereunto subscribed our names as witnesses.
