Will of John Fitzpatrick
from Newfoundland will books volume 2 page 536 probate year 1864

In re
     John Fitzpatrick deceased.

      In the name of God Amen.    I John Fitzpatrick of St. John’s Newfoundland Labourer being of sound mind memory and understanding do make declare and publish this my last will and testament I bequate my body to the ground in the hope of a glorious resurrection my soul to the bosom of a merciful Redeemer in the hope of a blistful eternity    I leave unto my two grandsons John Whealan and William Whealan all the monies belonging to me in the Savings Bank Bank and and all my other effects I leave unto the Reverend Jeremia O’Donnel five pounds to go for Masses for my soul I appoint the Reverend Jeremia O’Donnel my executor and Patrick Rochford my other executor Given under my hand and seal this the 3rd third day of November in the year of our Lord one thousand eight hundred and sixty three

Note: The wills in those will books are NOT actual wills. They are either hand-written copies or in later years typed copies of a, "last will and testament," written or typed by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor.

We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be.
