IN RE. DECEASED
WILLIAM B. FITZGERALD
I, William B. Fitzgerald of St John's in the island of Newfoundland make this as and for my last will and testament.
I hereby revoke all former wills codicils and testamentary dispositions of what kind so ever heretofore made by me.
I appoint my son-in-law Nicholas J. Wadden and my wife Katherine to be executors of this my will.
I givedevise and bequeath all my property of what kind so ever and wheresoever situated to my executors and direct them to hold the same in trust for the following purposes:
- To pay all my just debts and funeral expenses.
- To permit to my wife Katherine during her life the use occupation and enjoyment of the house I own and occupy of Maxse Street in the city of St John's or of any profits arising there from and together there with all my furniture and other effects therein contained.
- UPON the death of my wife Katherine to permit to my daughter Mary if she be not then married the use occupation and enjoyment of my said house or profits arising there from and said furniture and other effects until her marriage.
- Upon the marriage of my daughter Mary subsequent to my wifes death or upon my wifes death if Mary be previously married the said house furniture and other effects are to be held in trust for the benefit of or disposed of and the proceeds divided among my five children Alice Bridge Hetttie Mary and William share and share alike.
- Should my daughter Mary die unmarried subsequently to my wifes death the said house furniture and effects are to be held in trust for the benefit or are to be disposed of and the proceeds divided among my other four children share and share alike.
- In the event that any child of mine shall have died before the period of distribution of my said house furniture and other effects in accordance with the foregoing directions leaving issue living at the time of such distribution such issue shall stand in the place of such deceased child and take per stirpes and equally between them if more than one the share which such deceased child would have taken if he or she had been living at the time of distribution.
- All the rest residue and remainder of my property of what kind so ever I may die possessed of or entitled to I leave to my wife Katherine absolutely and forever.
