Will of Thomas Fitzgerald, from Newfoundland will books volume 15 page 296 probate year 1930

IN RE.          DECEASED

THOMAS FITZGERALD

This is the last will of me Thomas Fitzgerald of Mobile in the district of Ferryland Newfoundland retired fisherman and I revoke all former wills by me made I appoint my daughter Mary Geraldine and my nephew Laurence Fitzgerald of said district fisherman executors (hereinafter called my trustees) and trustees of this my will. (1) All the chattels real I shall die possessed of I give to my trustees for the use and benefit of my wife (Ellen) and said daughter Mary Geraldine and the survivor of them. After the death of the survivor upon trust for such children (if any) of my said daughter that may survive her. Failing any such children then the said chattels real or such as may be left shall go to the survivor or survivors of my nephews namely Laurence, Daniel, Patrick, Augustine, Thomas and Albert who may be living at the death of the survivor of my said wife and said daughter. 2. The residue of my estate I give to my said wife and daughter for their joint use absolutely. 3. It is my wish that if my wife and/or daughter (Mary Geraldine) require means for their support any or all of my chattels real may be disposed of for that purpose and when or how that may be done, I leave to the discretion of my trustees. 4. It is my wish that the life tenants of the said chattels real receiving the benefits there from shall discharge all outgoings that my trustees deem necessary for the upkeep and preservation of the said chattels real. In witness whereof I have set my hand to this my will this 8th of July 1926.
