Will of Anthony Figary, from Newfoundland will books volume 15 page 137 probate year 1930

Last Will and testament

To the Honorable, the Supreme Court of Newfoundland or to One of the Honorable Judges thereof:

The Petition of Albert Beer of Channel in the Electoral District of Burgeo in the Island of Newfoundland, Shopkeeper.
Humbly Sheweth that Anthony Figary, late of Channel, aforesaid, Labourer, died at that place on the ninth day of January A.D., One Thousand nine hundred and twenty-six, having first made and executed his last Will and Testament which is hereto annexed marked "A" and leaving heir surviving Sarah Figary, his widow. That the said Sarah Figary died at Channel aforesaid on the Seventh day of September A.D. One thousand nine hundred and twenty-eight.

That under the Said last Will and Testament your Petitioner was appointed Sole Executor thereof,

That at the time of his death the said Anthony Figary was possessed of Property of the probable value of Five hundred and twenty-five dollars.

That hereto Annexed, Marked "B" is a correct Inventory and Evaluation of the assets of the Estate of the Said Anthony Figary, deceased.

That no probate of the Said last Will and Testament nor Administration to the Estate of the Said Anthony Figary have been at any time applied for or granted.

Your Petitioner therefore humbly "prays" that Probate of the Said last Will and Testament of the Said Anthony Figary may be granted to him. And as in duty bound your Petitioner will every pray.

  1. I am the Petitioner named in the foregoing Petition.
  2. That the contents of the Said Petition are correct and true in every particular to the best of my knowledge and belief.

Annex A

IN RE.                DECEASED

ANTONY FIGARY

I Anthony Figary being in sound mind memory and understanding do make and publish this my last will and testament hereby revoking and making void all former wills by me heretofore made.
As is such an estate as it has pleased God to entrust me with, I dispose of the same as follows, namely.
I give and bequeath to my grandson Garfield Stickland my dwelling house, barn and land and all the rest of my belongings whatsoever or wheresoever situated. But in the case of the death of the aforesaid Garfield Stickland the aforestated dwelling house barn and land etc. become the property of my grandson Percy Figary. This will is not to come in force until after the death of my wife Sarah Ann Figary, and the property is hers as long as she lives, and is not to be disposed of until after her death.
And I do hereby constitute and appoint Albert Beer sole executor of my last will and testament.
In witness hereof I Anthony Figary the testator have to this my will set my hand and seal this Thirtieth day of October in the year of Our Lord one thousand nine hundred and twenty four.
