from Newfoundland will books vol 11 pages 213 & 214 probate year 1918

In re Charles Field       deceased

This is the last will and Testament of me, Charles Field, of Cook's Harbor, Fishermen.

  1. I hereby revoke all former wills by me at any time made and declare this to be my last will and testament.
  2. I hereby nominate constitute and appoint Susan Eddy, wife of Richard Eddy, of Cook's Harbor, to be the sole executrix of this my last will.
  3. All the property of which I die possessed of whatsoever nature and kind and wheresoever situated, and in particular all moneys deposited in my name in any Bank in Newfoundland I give, devise and bequeath to the said Susan Eddy in trust for her daughter, Christina Eddy, with instructions that no portion of my estate is to be expended for the support, maintenance and education of the said Christina Eddy unless the circumstances of her parents render it imperative in the best interests of the child. After the child becomes eighteen years of age, she may, in the discretion of her mother, receive some reasonable amount per year for such additional clothes and comforts as she may need over and above those provided by her parents; and on her attaining the age of Twenty-one years my entire estate shall be handed over to her. In the event of the said Christina Eddy dying before she attains the age of Twenty-one years I direct the said trustee to hold the estate in existence as at the date of her death in trust for her other daughter Debora Eddy. To be handed over to her on her attaining the age of twenty-one years.

- Dated at St. John's this 21st day of November AD 1916 - Charles Field - Signed by the said Testator as and for his last will and Testament in the presence of us, who, in the presence of the said testator and in the presence of each other do hereunto subscribe our names as witnesses. Note: The wills in those will books are NOT actual wills. They are hand-written copies of a, "last will and testament," written by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor.

We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be.
