Will of James Emberley from Newfoundland will books volume 14 page 204 probate year 1928

In re
      JAMES EMBERLEY.       DECEASED.

THIS IS THE LAST WILL AND TESTAMENT of me James Emberley, of St. John's, in the island of Newfoundland, Carpenter.
First - I revoke all former wills and testamentary dispositions by me at any time made.
Second - I appoint my sons, Stephen Emberley and Philip Emberley, the Executors of this my will.
Third- I give and bequeath my household furniture and effects together with my leasehold dwelling house and premises situate on Wood Street, in St. John's aforesaid, to my said sons Stephen and Philip TO HOLD the same as tenants in common for ever, Provided nevertheless that my said sons shall maintain and support my Daughter Maria during her lifetime or until she shall marry. Should either of my said sons fail to maintain and support my said Daughter during the period aforesaid then the interest of my said son so failing to maintain and support my said Daughter shall go to my other son. Should both of my said Sons fail to support and maintain my said Daughter during the said period then my said household furniture and effects together with my said dwelling house shall become the absolute property of my said Daughter.
Fourth - I give, devise and bequeath all my right title and interest in lands and premises situate in Bay de Verde to my said sons Stephen and Philip To HOLD the same as tenants in common for ever.
Fifth - All the rest, residue and remainder of my property of whatsoever nature and wheresoever situate, after paying all my just debts death duties, funeral and testamentary expenses, I give and bequeath to my said Daughter Maria and my said Sons Stephen and Philip share and share alike.
      IN WITNESS WHEREOF I have hereunto set my hand at St. John's, aforesaid, this 14th day of January in the year of OUR Lord One Thousand nine hundred and twenty Eight.
