In re DECEASED.
JAMES ELLIS.
THIS IS THE LAST WILL AND TESTAMENT of me, James Ellis of St. John's Engineer.
- I revoke all wills heretofore by me made
- I appoint my son-in-law, Charles
Peet of St. John's Grocer, to be the executor of this my last will
and testament.
- I give, devise and bequeath to my said executor Charles
Peet, everything whether real, personal or chattels real of which I shall
die possessed or entitled to (save and except any property hereinafter specifically
reserved out of this bequest) Upon trust, to hold the same for the use and
benefit of my wife, Martha Frances Ellis during her lifetime and upon her
death to transfer the same as follows:-
(a) To my son, William Ellis all my houses and lands on Leslie Street together
with the furniture and effects therein. It is however a condition of this
bequest that the said William Ellis shall at all times provide a home in
his house free of cost for my daughter, Della McCoubrey whilst she remains
unmarried and should she require him so to do. Also to transfer to my son
William Ellis all my stock in the Newfoundland Boot and
Shoe Company.
(b) To my daughter Della McCoubrey my stock in the Standard
Manufacturing Company.
( c) To my daughter, Martha Frances, wife of Charles Peet all my Southside
property and all my stock in St. John's Gas Light Company.
(d) All the rest, residue and remainder of my said estate to my three children
William, Della and Martha Frances share and share alike.
- Touching
my Masonic Life Insurance, which I reserve out of the bequests mentioned
in paragraph 3 of this my last will and testament, I direct my said executor,
out of the said fund, (a) to pay all my just debts funeral and testamentary
expenses, (b) to pay ten dollars to the Tasker Educational Fund, ten dollars
to the Church of England Orphanage, ten dollars to the Methodist Orphanage,
ten dollars to the Mercy Convent and ten dollars to the Mount Cashel Boys
Orphanage. ( c) to divide any sum remaining between my wife and children
share and share alike.
- I bequeath to my son William, my gold ring and to
my grand-son Ellis Peet my gold watch and chain which is to be given him
when he reaches the age of fifteen years. Both the said gold ring and watch
and chain are also reserved out of the bequests mentioned in paragraph 3
of this my last will and testament.
IN WITNESS WHEREOF I have hereunto subscribed my hand at
St. John's aforesaid this 2nd day of October A.D. 1919.
