To Wit

AFFIDAVIT.
----------

You shall swear that you believe this to be the true last Will and Testament of William Seager Green, late of Trinity in the Northern District of Newfoundland, Sub. Collector and Clerk of the Peace, deceased.

You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you; and that you will exhibit a true, full and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto: And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits, and Effects of the said William Seager Green, deceased, and of which he died possessed, do not, according to the best of your knowledge, judgment and belief, amount to the value of Four Thousand One Hundred Dollars.

So help you God.

The Petition of Mary Jane Green of Trinity, Widow and Charles W. Green of same place, gentleman

Humbly Sheweth

          That William S. Green (the late Husband of your Petitioner Mary Jane Green) died at Trinity in the Northern District of Newfoundland on or about the Fifth day of May 1886 leaving him surviving seven (7) children - viz. Sophy, Mary, William, Edward, Henry, Chatfield & Charles.
          That the said deceased was possessed of property and effects (including a Life Policy for Five Hundred Pounds Sterling) of the probable value of Four Thousand Dollars.
          That the said deceased left a Will, which has been proven in due form of law on the affidavit of the Honorable F.B.T. Carter K.C.M.G., which said Will and proof are hereto annexed marked A and B respectively.
          That no probate or administration has as yet been taken out to said Estate.
          Your petitioners therefore pray that (as they have been nominated Executrix and Executor respectively with Edward S. Green of South Norwood, London) they may in and under said Will, * probate may be granted to them and as in duty bound will ever pray.

This is the last Will and Testament of me, William Seager Green of Bay Roberts in the Island of Newfoundland, Merchant. In the first place, I desire that all my just debts, funeral and testamentary expenses be paid out of my Estate.
Secondly, I give, devise and bequeath to my Wife Mary Jane Green and to her Heirs and assigns for ever, all property both real and personal of which I may die possessed or to which I or my Heirs may thereafter be entitled to, and also any amount of money that may become due for principal interest, bonuses or otherwise on any and all Insurances now, or hereafter to be, effected upon my life - and I hereby appoint my said Wife and my sons Charles W. Green and Edward S. Green Executrix and Executors to this my last Will and Testament and hereby revoke and anul all other Wills by me heretofore made and declare this to be my last Will and Testament.
In witness whereof I have hereunto set and subscribed my hand and seal at Saint John's in the Island aforesaid this second day of March in the year of our Lord One Thousand eight hundred and sixty eight.

SUPREME COURT OF NEWFOUNDLAND

TO WIT}
Sir F.B.T.Carter K.C.M.G. of Saint John's, Chief Justice of the Supreme Court of Newfoundland, maketh oath and saith that on the Second day of March A.D. one thousand eight hundred and eighty sixty eight at Saint John's aforesaid he, this Deponent, was present and did see William S. Green, late of Bay Roberts, the Testator named in the paper writing hereto annexed, duly sign, publish and declare the said annexed paper writing as and for his last Will and Testament, in the presence of this Deponent and of John Hayward and Thomas R. Bennett, the other subscribing witnesses thereto. That Deponent and said John Hayward and Thomas R. Bennett then and there signed their names to such Will as such witnesses, in the presence of the said Testator and of each other and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.
