AFFIDAVIT.

You shall swear that you believe this to be the true last Will and Testament of Joseph Gorman, late of St. Pierre Miquelon, Merchant, deceased.
You shall swear that you will pay all the Debts and Legacies of the Deceased, so far as the Goods shall extend and the Law shall bind you; and that you will exhibit a true, full and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when you shall be lawfully called thereto: And you shall further swear that the whole of the Goods, Rights, Chattels, Assets, Credits, and Effects of the said
Joseph Gorman, deceased, and of which he died possessed, do not, according to the best of your knowledge, judgment and belief, amount to the value of Three Thousand Five Hundred Dollars.
So help you God.

The Petition of Robert J. Kent of St. John's
in the said Island, one of Her Majesty's
Counsel and of Julien Deville at present of
St. John's but a resident of St. Pierre
Miquelon, Clerk in the Treasure there
Humbly Sheweth
That Joseph Gorman of St. Pierre aforesaid, merchant, died there on or about the twenty sixth day of May last past having first made and executed his last will and testament as hereto annexed and which will has been duly proved in common form
That said deceased left him surviving his widow Sara and three children, of whom two are resident in St. Pierre aforesaid and one in France.
That he died possessed of property some of which is situate in St. Pierre aforesaid and some in this Colony.
That the portion of his Estate situate within the jurisdiction of this Honorable Court is of the probable value of about Three Thousand dollars.
That no probate or administration of the Estate of said deceased has been hitherto granted.
That in and by his said last will and testament he nominated and appointed your petitioners and Mr. Michael Gorman of Burin in this Island but now resident of St. Pierre aforesaid, planter, as Executors thereof.
Petitioners pray that probate of the said will so far as it relates to the assets of the Estate of Testator situate within the jurisdiction of this Honorable Court may be granted to him and as in duty bound they will ever pray &c &c &c.

In the name of God. Amen.
I, Joseph Gorman of St. Pierre Miquelon do make and publish and declare this as and for my last will and testament.
First. I give devise and bequeath to my son James Gorman all my goods, chattels, merchandise, stock in trade and effects whatsoever whether the same be in St. Pierre Miquelon aforesaid, at Millers Passage or elsewhere, all such moneys as may be in my possession or belonging to me at the time of my decease. All my shares of and in the Screw Steamship "Shattuck", all my shares of and in the Steamship "Alice", all my right and interest in the Brick store and premises situated in Rue de Seiza at St. Pierre, and in the Gun point Yard and shed, and in the Brick dwelling house and garden situate in Joinville Street, St. Pierre, also the schooner "Messena" and "Vesta" and the Lighter Boats and seine skiffs at Millers Passage aforesaid, also all my lands and premises and all stores and other buildings thereon situate at Millers Passage, also all such debts as are or shall be due and owing to me by any person or persons whomsoever and wheresoever, but it is my will and desire that my said son shall leave the matters above mentioned invested in my trade and business and shall carry on the same, as I have been accustomed to do, for a period of five years from the ninth day of January Anno Domini One thousand eight hundred and eighty five. And the above bequest to my said son is subject to the express condition that he shall pay, liquidate and discharge all of my just debts, my funeral and testamentary expenses. And is also made upon and subject to the Trusts following and to each of them. That is to say, upon Trust to pay or cause to be paid to my beloved wife Sarah, should she survive me, the sum of eleven
thousand francs. And, to my daughter Mary Bridget, the sum of Eight thousand francs. And, to my daughter Susannah Pauline, the sum of Eight thousand francs. Also towards the support and maintenance of the children at and in L'Onorios or Orphanage at St. Pierre aforesaid the sum of One thousand one hundred francs, such payment to be made to the superioress of the said establishment for the use and purposes of the said institution. Also, upon trust that he shall invest or cause to be invested in some good and safe securities the sum of Two thousand two hundred francs and pay and apply the annual interest arising from such investment for the celebration of masses for the repose of my soul.
Second. I give, devise and bequeath to my beloved wife Sarah, for her own use and benefit, my house situate at St. Pierre aforesaid and commonly called or known as "The Cottage" together with the land and premises thereto attached. Also the piece of land or yard situate in St. Pierre between the store of Messrs Sheehan and Company and the Government buildings, also the garden and stable situate opposite the Telegraph Company's Office and my farm situate on the Savoyard Road. And all my household furniture and effects in the dwelling house now occupied by me at St. Pierre aforesaid.
Third. I give, devise and bequeath to my daughter Mary Bridget one of those two dwelling houses of mine situate in the vicinity of the Telegraph Company's Offices in St. Pierre aforesaid and to my daughter Susannah Pauline the other of the said dwelling houses.
Fourth. As regards my shares in the Capital Stock of the Commercial Bank of Newfoundland, I give, devise and bequeath one third part or share of the value thereof to my daughter Mary Bridget, one third part or share thereof to my daughter Susannah Pauline and the remaining one third part or share thereof to my beloved wife Sarah.
Fifth. I hereby nominate and appoint my brother Thomas Gorman of Burin in Newfoundland, Mr. Robert J. Kent, attorney resident in St. John's, Newfoundland, Mr. Michael Gorman of Saint Pierre & Mr. Julien Deville of Saint Pierre as Executors of this my last will and testament.
And lastly, I do hereby revoke and declare null all wills by me heretofore made.
Witness my hand at St. Pierre aforesaid this third day of April Anno Domini one thousand eight hundred and eighty five.

Julien Deville of St. Pierre Miquelon, Clerk of the Treasury* maketh oath and saith that on the third day of April A.D. one thousand eight hundred and eighty five at St. Pierre aforesaid he, this Deponent, was present and did see Joseph Gorman, late of St. Pierre aforesaid the Testator named in the paper writing hereunto annexed duly sign (by making his mark) publish and declare the said annexed paper writing as and for his last Will and Testament, in the presence of this Deponent and of ** Michael Gorman of Saint Pierre aforesaid, gentleman, *** the other subscribing witness thereto. That Deponent and said Michael Gorman then signed their names to such Will as such witnesses, in the presence of the said Testator and of each other-That previously to the said Will being so signed as aforesaid, by the said Testator and the said witnesses, it was read over to, and approved of by the said Testator in the presence of Deponent and the said Michael Gorman and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.
