TO THE HONOURABLE THE SUPREME COURT OR TO ONE OF THE HONOURABLE JUDGES THEREOF

THE PETITION

Rupert W. Bartlett of St. John's, in the Province of Newfoundland.

HUMBLY SHOWETH THAT:-

  1. Mary E. Howell, late of Carbonear, Spinster, died at St. John's in the Province of Newfoundland, on or about the 29th., day of February, A.D., 1960, having previously made her Last Will and Testament, wherein she appointed your Petitioner Executor thereof which Will is hereto annexed and marked "A".

  2. The deceased left her surviving the following next-of-kin and no others namely:-
    (a) John Howell, brother of the deceased, residing in Massachusetts, in the United States of America.
    (b) Lewis Howell, brother of the deceased, residing in Massachusetts, in the United States of America.

  3. At the time of her death, the said deceased was possessed of property within the jurisdiction of this Honourable Court of the probable gross value of $13,452.01, as appears from the Inventory hereunto annexed marked "B".

  4. No probate or any Will or Letters of Administration of the Estate of the said deceased have been at any time granted by this Honourable Court. S.J.O

Your Petitioner therefore humbly prays that this Honourable Court of Your Lordship may be pleased to grant to him Letters of Probate of the Last Will and Testament of the deceased.

DATED at St. John's aforesaid, this 15th., day of March, A.D., 1960.

THIS IS THE LAST WILL AND TESTAMENT of me, Mary E. Howell of Carbonear, in the Province of Newfoundland.

  1.           I hereby revoke all former Wills and Testamentary dispositions made by me.
  2.           I nominate and appoint Rupert W. Bartlett sole Executor and Trustee of this my Will. R.W.B., M.E.H., E.O.
  3.           I give devise and bequeath all of my estate both real and personal of whatsoever kind and wheresoever situate to my Trustee to hold upon the following trusts:
    (a) To pay all my just debts, funeral and testamentary expenses.
    (b) To pay to the building fund of the Carbonear United Church, the sum of $500.00.
    ( c) I direct my Trustee to establish a trust fund of $400.00 for the perpetual upkeep of my grave. It is my wish that I shall be buried in the family plot near my grand-parents James Howell with one monument marking all graves.R.W.B., M.E.H., E.O.
    (d) To pay to my niece, Mrs. Walter Douglas, 5 Middle Street, Newbury Port, Massachusetts, the sum of $100.00.
    (e) To pay to my niece, Mrs. A. P. Roberts, 4533 Calumet Street, Metairie, Lousianna, the sum of $100.00.
    (f) To pay to my niece, Miss Jeannie Howell, 55 Prince of Wales Street, St. John's, Newfoundland, the sum of $100.00
    (g) To pay to my niece, Mrs. Shirley Thistle, St. Catherine's, Ontario, the sum of $100.00.
    (h) To pay to my niece, Miss Janet Howell, 55 Prince of Wales Street, St. John's, Newfoundland, the sum of $100.00.
    (i) To pay to my cousin, Mrs. Mark Badcock, 18 Wood Street, St. John's, the sum of $100.00.
    (j) To pay to Mrs. Minnie Howell, 55 Prince of Wales Street, St. John's, the sum of $500.00.
    (k) To pay to Miss Millie Howell, 14 Merrymeeting Road, St. John's, the sum of $500.00. (1st cousin)
    (l) I give devise and bequeath to my brother, John Howell, 24 Fell Street, Greenwood, Massachusetts, 500 shares in Saunders, Howell & Company Limited.
    (m) I give, devise and bequeath to my brother, Lewis Howell, 14 Island Avenue, Everrett, Massachusetts, 200 shares in Saunders, Howell & Company Limited.
    (n) I give, devise and bequeath my fur coat to Mrs. Blanche Howell, Carbonear.
    (o) I give, devise and bequeath my refrigerator and sewing machine to Mrs. Mary Howell, Carbonear.R.W.B., M.E.H., E.O.
    (p) I give, devise and bequeath all my pewter, china ware, brass ware, ornaments, etc. to my cousin, Miss Jean Howell, 18 Wood Street, St. John's.
    (q) I give, devise and bequeath all the rest and residue of my Estate, of whatsoever kind and wheresoever situate, to my said brother, John Howell.

IN WITNESS WHEREOF I have hereunto subscribed and set my hand at St. John's, this 29th., day of February, A. D., 1960.
