          ST. JOHN'S, NEWFOUNDLAND

IN RE ESTATE                               In the Supreme Court

Deceased

          In pursuance of the provisions of "The Death Duties Acts 1914 to 1916" and Amendments thereof, I hereby certify that the value of the said estate, after making allowance for debts incurred during the life time of the deceased, and due and payable at the time of her death was $88.00 and that the sum of $--- being the duties specified in the Schedule of the said Acts have been duly paid, and the receipt thereof is hereby acknowledged.

          Dated at St. John's this 14th day of February 1918

          The Petition of James Smith of Saint John's Engineer

HUMBLY SHEWETH.

  1.           That Eliza Howell of Saint John's aforesaid Widow deceased died there on or about the 5th day of February A. D. 1918 intestate leaving her surviving as next of kin three Sons viz: James Smith (Your Petitioner) Walter Howell of Saint John's aforesaid Truckman and William Howell of the same place Wharfinger.
  2.           Said deceased at the time of her death was possessed of property within the jurisdiction of Your Honourable Court of the probable value of $8800
  3.           The Inventory and valuation hereto annexed marked "A" is to the best of Petitioner's knowledge information and belief a just and true Inventory and valuation of the property estate and effects of said deceased at the time of her death as far as Petitioner can at present ascertain.
  4.           No Probate of any Will no Letters of Administration to the Estate of said deceased have been granted to any person.
  5.           Petitioner therefore prays that Letters of Administration to the Estate of said deceased may be granted to him

          And as in duty bound he will ever pray etc.

Know all Men by these Presents THAT WE James Smith of Saint Johns, Engineer, Thomas McDonald of the same place, Gardener, and William Sage of the same place, Shoemaker, are jointly and severally bound unto Our Sovereign Lord GEORGE THE FIFTH, by the Grace of GOD, of the United Kingdom of Great Britain and Ireland, and of the British Dominions beyond the Seas, King, Defender of the Faith, &c., in the sum of one hundred seventy six dollars, to be paid to Our said Sovereign Lord the King, His Heirs and Successors, for which payment, well and truly to be made, we bind ourselves, and each of us for the whole, our and each of our Executors and Administrators, firmly by these Presents. Sealed with our seals.
          Dated the 18th day of February, in the year of our Lord 1918

The Condition of this Obligation is such that if the above named James Smith, Administrator of all the Estate and Effects of Eliza Howell, late of Saint Johns in the Island of Newfoundland, widow deceased (who died on or about the 5th day of February, 1918), do, when lawfully called on in that behalf, make, or cause to be made, a true and perfect inventory of all and singular the Estate and Effects of the said deceased, which have or shall come into his hands, possession or knowledge, or into the hands or possession of any other person or persons for him, and the same so made do exhibit, or cause to be exhibited, into the Registry of the Supreme Court of Newfoundland whenever required by law so to do, and the same Estate and Effects, and all the other Estate and Effects of the said deceased at the time of her death, which at any time after shall come into his hands or possession, or into the hands or possession of any other person or persons for him, do well and truly administer according to law, that is to say , do pay the debts which the said deceased did owe at her deceased; and further, do make, or cause to be made, a just and true account of his said administration within twelve months from this date, or whenever required by law so to do, and all the rest and residue of the said Estate and Effects, do deliver and pay unto such person or persons respectively as shall be entitled thereto under any law now in force or that may hereafter be in force in Newfoundland; and if it shall hereafter appear that any last will and testament was made by the said deceased, and the Executor or Executors therein named do exhibit the same unto the said Court, making request to have it allowed and approved accordingly, if the said James Smith being thereunto required, do render and deliver the said Letters of Administration (Approbation of such testament being first had and made) in the said Court; then this Obligation to be void and of no effect, or else to remain in full force and virtue.

We, Thomas McDonald of Saint Johns, gardener, and William Sage of the same place, Shoemaker severally make oath and say: That we are the proposed Sureties on behalf of James Smith the intended Administrator and all and singular the Estate and Effects of Eliza Howell deceased, in the within Bond named, for the faithful administration of the said Estate and Effects of the said deceased; and I, the said Thomas McDonald, for myself make oath and say that I am worth property to the amount of one hundred seventy six dollars, over and above all encumbrances, and over and above what will pay my just debts, and every other sum for which I am now bail, or which I am liable as surety or endorser, or otherwise; and I, the said William Sage, for myself make oath and say that I am worth property to the amount of One hundred and seventy six dollars, over and above what will pay my just debts, and every other sum for which I am now bail, or for which I am liable as surety or endorser, or otherwise.

I, James Smith of Saint Johns, in the Electoral District of Saint Johns in the Island of Newfoundland, Engineer, make oath and say that
Eliza Howell
late of Saint Johns, in the Electoral District of Saint Johns in the Island aforesaid, widow deceased died intestate; that I will well and faithfully administer the estate and effects of the said deceased, by paying her just debts and distributing the residue of her estate and effects according to law; that I will exhibit a true and perfect inventory of all and singular the said estate and effects, and render a just and true account thereof whenever required by law so to do; that the said deceased died at Saint Johns aforesaid on the 5th day of February, one thousand nine hundred and eighteen; and that the gross value of the said estate and effects of the deceased is eighty eight dollars, and no more, according to the best of my knowledge, information and belief
