In the Estate of John Connolly of Trinity DECEASED.

I, Arthur Power of Trinity in the Electoral District of Trinity in the Island of Newfoundland, Dealer, make oath and say:
That I believe the paper writing hereto annexed and marked by me to contain the true and original last Will and Testament of John Connolly late of Trinity in the Electoral District of Trinity, in the Island of Newfoundland, Planter, deceased: and that I will well and faithfully administer the estate and effects of the testator by paying his just debts and the legacies contained in his Will and by distributing the residue of the said estate, rights and credits according to law: and that I will exhibit under oath a true, full and perfect inventory of all and singular the estate and effects, rights and credits, and render a just and true account thereof whenever required by law so to do: that at the time of his death the said deceased had a fixed place of abode in the Island aforesaid; and that the gross value of the estate and effects, rights and credits of the said testator is Eleven hundred and twenty two dollars, and no more, according to the best of my knowledge, information and belief.

The petition of Arthur Power of Trinity in the Northern District:

Humbly Sheweth

  1. That John Connolly late of Trinity deceased, died there on or about the 8th day of September ??? present having first made and executed his last will and testament which said will is hereto annexed marked A.
  2. That no executor was nominated or appointed in or by the said last will and testament of your petitioner as administrator of the estate of the said testator with the will annexed as appears by the paper writing hereto annexed marked B.
  3. That the said John Connolly died possessed of property within the jurisdiction of this honorable Court to the probable value of $1122.00 as appears by the schedule hereto annexed marked C.
  4. That no probate of the will or administration of the estate of the said John Connolly has heretofore been granted to anyone.

          Your petitioner therefore prays that letters of administration with the will annexed of the estate and effects of the said John Connolly may be granted forth of this honorable court to him and as in duty bound he will ever pray &c &c &c.

I John Connolly do hereby make this my last will and testament.
I will and bequeath to Mr. Arthur Power my dwelling house on the ??? side of Trinity & personal effects in house on North side.
I will to Thomas Connolly all property not otherwise disposed of. I will to the Rev. T? G. Lynch

one hundred dollars ($100.00) for masses for my soul. I will to Rev. W. J. Lynch four hundred dollars ($400.00). This amount is in trust for Trinity R.C. Church. I will to A. Power twenty eight dollars for a headstone for myself and wife. I will the balance of my money to Rev. W. J. Lynch for Church (R. Catholic) at Trinity.

I Thomas Sullivan of Kings Cove in Bonavista Bay make oath and say that on the 9th day of July A.D. One Thousand Eight Hundred and Ninety Nine at  Trinity, Trinity Bay, I was present and did see John Connolly late ofTrinity aforesaid Planter the Testator named in the paper writing hereunto annexed marked A, duly sign (by making his mark) , publish and declare the said annexed paper writing as and for his last Will and Testament, in my presence and in the presence of Margaret Clarke, the other subscribing witness thereto. That I and said Margaret Clarke then and there signed our names to such Will as such witnesses, in the presence of the said Testator and of each other, that previously to the said Will being so signed as aforesaid, by the said Testator and the said witnesses, it was read over to, and approved of by the said Testator in the presence of me and the said Margaret Clarke, and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of my knowledge and belief.

Know all Men by these Presents: That we Arthur Power of Trinity Dealer, and Robert S. Brewer also of Trinity merchant and Francis Ash of Trinity aforesaid Master Mariner are jointly and severally bound unto our Sovereign Lord, Edward VII, by the Grace of God, of the United Kingdom of Great Britain and Ireland, King, Defender of the Faith, &c, in the sum of Twenty two hundred and fifty dollars, to be paid to our said Sovereign Lord, the King, His Heirs and Successors for which payment well and truly to be made, we bind ourselves and each of us for the whole, our and each of our executors and administrators, firmly by these presents. Sealed with our seals.

Dated the 31st day of October in the year of our Lord 1901.

The Condition of this obligation is such that if the above named Arthur Power as administrator of all the estate and effects, rights and credits of John Connolly late of Trinity in the Island of Newfoundland Planter deceased, (who died on or about the 8th day of September A.D. 1901) do, when lawfully called on in that behalf, make, or cause to be made, a true and perfect inventory of all and singular the estate and effects, rights and credits of the said deceased, which have or shall come into his hands, possession or knowledge or into the hands or possession of any other person or persons for him and the same so made do exhibit, or cause to be exhibited, into the Registry of the Supreme Court of Newfoundland, whenever required by law so to do, and the same estate and effects, rights and credits, and all other estate and effects, rights and credits of the said deceased at the time of his decease, and further, do make, or cause to be made, a full true and just account of his administration within twelve months or sooner if thereunto required, and all the rest and residue of the property shall deliver and pay unto such person or persons as shall be by law entitled thereto; then this obligation to be void and of no effect, or else to remain in full force and virtue.

We Robert S. Brewer, Merchant, and Francis Ash, Master Mariner, both of Trinity, in the Northern District, severally make oath and say:
That we are the proposed sureties on behalf of Arthur Power the intended administrator of all and singular the estate and effects, rights and credits, of John Connolly, deceased, in the within bond named, for the faithful administration of the said estate and effects, rights and credits, of the said deceased; and I the said Robert S. Brewer for myself make oath and say that I am worth property to the amount of Eleven hundred and twenty two dollars, over and above all encumbrances and over and above what will pay my just debts, and every other sum for which I am now bail, or for which I am liable as surety or endorser or otherwise, and I the said Francis Ash for myself, make oath and say, that I am worth property to the amount of Eleven hundred and twenty two dollars, over and above what will pay my just debts, and every other sum for which I am now bail and for which I am liable as surety or endorser or otherwise.
