In the Estate of Peter Butler of Port de Grave deceased

Right Reverend Edward Fenwick Walsh in the Electoral District of Brigus, Catholic Priest, make oath and say that I believe the paper writing hereto annexed and marked by me to contain the true and original last Will and Testament of Peter Butler late of Port de Grave in the Electoral District of Brigus, deceased. That I am the Executor therein named and that I will well and faithfully administer the estate and effects of the testator by paying his just debts and the legacies contained in his Will so far as the same shall thereto extend and the law shall bind me, and by distributing the residue (if any) of the estate according to law; and that I will exhibit a true, full and perfect inventory of all and singular the estate and effects, rights and credits, of the testator and render a just and true account thereof whenever required by law so to do; that the testator died at Port de Grave aforesaid on the 25th day of August, one thousand nine hundred and one, and that the gross value of the estate and effects, rights and credits, of the said testator is Two thousand and fifty five dollars, and no more, according to the best of my knowledge, information and belief.

St. Johns
S.S.          I, James M. Kent of St. Johns Barrister at Law make oath and say as follows:

  1. That Peter Butler of Port de Grave, Merchant died there on or about the 23rd day of August A.D. 1901.
  2. That the handwriting of the said Peter Butler is well known to me.
  3. That the paper writing or Will hereto annexed marked (A) is entirely in the proper handwriting of the said Peter Butler and the signature Peter Butler hereto affixed is the proper signature of the said Peter Butler and in his own handwriting.
  4. That I believe that the said Peter Butler was at the time of his making his said Will of sound mind and memory and understanding.

In the name of God Amen
I, Peter Butler, Merchant of Port de Grave in Conception Bay, do make publish and declare this as and for my last Will and Testament. I give and bequeath to Monsignor Walsh all such lands, houses, goods and chattels, moneys, securities for money, Estate and effects whatever nature and kind the same may be as I may die possessed of upon trust in the first place to sell and dispose of the same to the best advantage and from and out of the proceeds thereof to pay off and discharge all my just debts funeral and testamentary expenses and the remainder of my Estate give devise & bequeath to Monsignor Walsh to be used and disposed of at his discretion for Church purposes or other Charitable uses. I nominate and appoint Monsignor Walsh & Patrick Nowlan, Esq. Executors of this my Will, and I do hereby revoke, annul and declare void all Wills by me heretofore made.
Witness my hand at Port de Grave aforesaid this 21st day December 1894

The petition of Right Reverend Monsignor Edward F. Walsh of Brigus, Catholic Clergyman.

Humbly Sheweth

  1. That Peter Butler of Port de Grave, Merchant, died there on or about the 23rd day of August, having first made and executed his last will and testament which is hereto annexed marked (A).
  2. That your petitioner and Patrick Nowlan are appointed to and by the said the to be the [sic] executor thereof and that the said Patrick Nowlan is now deceased.
  3. That the said testator died possessed of property within the jurisdiction of this Honorable Court to the probable value of $2000.00
  4. That no probate to the will has before been granted to anyone.

          Petitioner therefore prays that letters of probate to the will of the said Peter Butler deceased be granted forth of this Honorable Court to him, the surviving executor in the said will named.
          Dated at Brigus this 13th day of September Anno Domini 1901
