NOTICE

Three days from date hereof application will be made to the Honourable the Supreme Court or to one of the Honourable the Judges thereof for Probate of the will of Samuel Brown, late of Salvage, fisherman, deceased, to be granted to Kenneth Brown, Executor, therein named.

I Joliffe Quinton of Seal Cove in the Electoral District of Bonavista, but at present of St. Johns, Purser, make oath and say that on the 22nd day of June A.D. One Thousand Nine Hundred, I was present and did see Samuel Brown late of Salvage, Fisherman, the Testator named in the paper writing hereunto annexed, marked A, duly sign, publish and declare the said annexed paper writing as and for his last Will and Testament, in my presence and in the presence of Darius? Blandford the other subscribing witness thereto. That I and said Darius Blandford then and there signed our names to such Will as such witnesses, in the presence of the said Testator and of each other and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

A

THIS is the last will and testament of me Samuel Brown of Salvage, Fisherman, I give devise and bequeath to my executor hereinafter named all the property moneys goods debts and effects of every nature and kind of which I may die possessed (save and except the bequest hereinafter mentioned to my wife Emily) in trust as follows :-

FIRST The landed property on which I now reside, together with the house in which I live, for the use of my wife Emily until her death or re-marriage which ever shall first occur, my son Charles Bendell Brown to be entitled to reside with her in the same house until he attains the age of twenty one years or marries, and after for so long a time as my said wife shall desire.

SECOND The remainder of my property of every kind for the support and maintenance of my wife Emily during her lifetime or so long as she remains a widow, and my son Charles Bendell Brown until he shall have attained the age of twenty one years.

THIRD In the event of my said wife Emily remarrying or dying during the lifetime of my said son Charles Bendell Brown all the property moneys goods debts and effects of or belonging to me of every nature and kind shall be administered by this executor for the support and maintenance of my said son Charles Bendell Brown until he attains the age of twenty five years, and then be assigned to him for his use for life or until the birth of lawful issue of him, and then be assigned to him as his sole and absolute property upon the birth of such lawful issue.

FOURTH In the event of my said son Charles Bendell Brown dying

without issue during the lifetime of my said wife Emily, the said property moneys goods debts and effects on her decease or re-marriage to be divided equally between my brothers James, John, and Henry.

FIFTH In the event of my said wife Emily dying during the lifetime of my said son Charles Bendell Brown, or re-marrying, and my said son Charles Bendell Brown dying before he attains the age of twenty five years, without issue, the moneys goods debts and effects shall be divided equally between my said brothers James, John and Henry.

SIXTH In the event of my said wife Emily re-marrying or dying, after the death of my said son Charles Bendell Brown, and before he attains the age of twenty five years, if there should be issue of my said son Charles Bendell Brown, living at the time of her death or re-marriage, all the said property moneys goods debts and effects shall be assigned on her re-marriage or death to the said issue of my said son Charles Bendell Brown AND in the event of my said son dying before he attains the age of twenty five years, and there being no issue of my said son surviving at the time of the death or re-marriage of my said wife Emily, the said property moneys goods debts and effects shall be equally divided between my said brothers James, John and Henry.

TO my beloved wife Emily I give and bequeath the sum of two hundred dollars for her sole and separate use.

I appoint Kenneth Brown of Salvage Fisherman Executor and Trustee of this my will.

TO THE HONOURABLE THE SUPREME COURT OR TO ONE OF THE HONOURABLE JUDGES THEREOF.

The Petition of Kenneth Brown of Salvage, in the Electoral District of Bonavista, Fisherman.

Respectfully sheweth as follows :--

  1. Samuel Brown, late of Salvage, in the Electoral district of Bonavista, Fisherman, died there on the 17th day of January last, having previously made and executed his Last Will and Testament which is hereto annexed marked "A", and proved in common form.
  2. The said deceased, in and by his last Will, appointed your Petitioner Executor and Trustee thereof.
  3. At the time of his death, the said deceased was possessed of property of the value of $254869/100 as per inventory hereto annexed marked "B".
  4. No probate of Will or Letters of Administration of the estate of said deceased have been previously applied for.

          Your Petitioner therefore prays that probate of the Will and Testament of the said Samuel Brown, deceased, may be granted to him.
          And as in duty bound will ever pray.

          Dated at St. Johns this 21st day of October A.D. 1901

I, Kenneth Brown of Salvage in the Electoral District of Bonavista, Fisherman, make oath and say that I believe the paper writing hereto annexed and marked by me to contain the true and original last Will and Testament of Samuel Brown late of Salvage, in the Electoral District of Bonavista, deceased: That I am the Executor therein named and that I will well and faithfully administer the estate and effects of the testator by paying his just debts and the legacies contained in his Will and distributing the residue (if any) of the estate according to law; and that I will exhibit under oath a true, full and perfect inventory of all and singular the estate and effects, rights and credits, of the testator and render a just and true account thereof whenever required by law so to do; that the testator died at Salvage on the Seventeenth day of January one thousand nine hundred and one; and that the gross value of the said estate and effects, rights, and credits of the said testator is Two thousand five hundred and forty-eight 69/100 dollars and no more, according to the best of my knowledge, information and belief.
