NOTICE

Three days from date hereof application will be made to the Honorable the Supreme Court or to one of the Honorable the Judges thereof for Probate of the Will of James Brown Senior, late of Bishop's Harbor, Salvage, in the Northern District, Fisherman deceased, to be granted to Kenneth Brown (of William) the Executor therein named.
          Dated at St. Johns this 27th day of November A.D. 1900

This is the last will of me, James Brown (Senior) of Bishops Harbor, Salvage, Bonavista Bay, in the Colony of Newfoundland.

  1. I give and bequeath to my son, James Brown, my dwelling house situate in Bishops Harbor, and all out houses at present appertaining thereto, together with all the heavy furniture in the said dwelling house belonging to me at the time of my death, such as bedsteads, tables, stoves, &c
  2. And I give and bequeath to my son, James Brown, aforesaid, all my flakes situate in Bishops Cove (a part of Bishops Harbor) aforesaid.
  3. The garden attached to my dwelling house aforesaid, I give and bequeath to my son, James Brown, aforesaid
  4. All other lands which I possess or am entitled to at the time of my death, I desire to be equally divided between my four sons, Henry Brown, John Brown, Samuel Brown, and James Brown aforesaid.
  5. The flakes situate on the north shore of Bishops Harbor, I give to my two sons, John Brown and Henry Brown aforesaid, to be equally divided between them

  6. My stage room, wharf, and part of store I give to my four sons, Henry Brown, John Brown, Samuel Brown, and James Brown all aforesaid, to be divided between them, provided always that each one of the said four sons does an equal share with the others of the work necessary for keeping the said stage, room, wharf, and part of store in good repair. But should one or more fail in fulfilling this condition relative to repairs, then his share (or their shares if more than one fail in fulfilling the said condition) shall be divided equally amongst those who fulfill the requirement.
  7. I give my family Bible to my son, James Brown, aforesaid, and my watch I give to my grandson, Charles B. Brown, son of my son, Samuel Brown, aforesaid.
  8. I give and bequeath the sum of four hundred dollars ($400) to my daughter, Mrs. Susannah Moss, wife of Robert Moss of Sailor's Island.
  9. I give and bequeath the sum of three hundred dollars ($300) to my daughter, Mrs. Georgina Ralph, wife of Charles Ralph of Sailor's Island.
  10. I give and bequeath the sum of twenty dollars ($20) to my grandson Samuel James Ralph, son of my daughter, Mrs. Georgina Ralph

  11. I give and bequeath the sum of forty dollars ($40) to Mrs. Elizabeth Turner, wife of Benjamin Turner of Happy Adventure.
  12. All the remainder of the money of which I may be in possession at the time of my death I give to my four sons, Henry Brown, John Brown, Samuel Brown, and James Brown all aforesaid, to be equally divided between them, each one of the four to receive a fourth part of the said remainder of the money of which I am possessed or entitled to.
  13. I appoint Kenneth Brown (Son of William Brown) executor of this my will, and I revoke all former wills and codicils. Dated this Sixth day of May 1898.

In the name of God

          This is the last will or codicil of me James Brown of sound mind and good understanding. My former wife standing unaltered with the exception, that is to say - I give and bequeath to my Daughter Georgenia[sic] Ralp? the same amount of money as my Daughter Susanna Moss, an equal sum, I give and bequeath my feather bed to my Grandson Theodore Brown and about half the clothing belong [sic] to the said bed. The amount of money I bequeathed to my son Samuel Brown in my former Will is to go (after my son Samuel's death) to his son Charles Brown. All other matters being previously settled in my former Will, I leave unaltered.
Dated this fifteenth day of September Anno Domini one thousand nine hundred.

One Thousand Eight Hundred and ninety eight I was present and did see James Brown Senior, late of Bishop's Harbor, Salvage, the Testator named in the paper writing hereunto annexed, marked A,  duly sign, publish and declare the said annexed paper writing as and for his last Will and Testament, in my presence and in the presence of Reverend Harold F. Wilson, the other subscribing witness thereto. That I and said Reverend Harold F. Wilson then and there signed our names to such Will as such witnesses, in the presence of the said Testator and of each other, and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

One Thousand Nine Hundred I was present and did see James Brown Senior, late of Bishop's Harbor, Salvage, Fisherman, the Testator named in the paper writing hereunto annexed, marked A, duly sign, publish and declare the said annexed paper writing as and for a Codicil to his last Will and Testament, in my presence and in the presence of Andrew Brown, the other subscribing witness thereto. That I and said Reverend Andrew Brown then and there signed our names to such Will as such witnesses, in the presence of the said Testator and of each other, and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

TO THE HONOURABLE THE SUPREME COURT OR TO ONE OF THE HONOURABLE THE JUDGES THEREOF.

The Petition of Kenneth Brown of Bishop's Harbor in the Electoral District of Bonavista.

Respectfully sheweth as follows :--

  1. James Brown late of Bishop's Harbor in the Electoral District of Bonavista, Planter, died there on the 19th day of October A.D. 1900, having previously made and executed his last Will and Testament, and a codicil thereto, which are hereto annexed marked "A" and "B" respectively.
  2. The said deceased in and by his last Will and codicil appointed your Petitioner executor thereof.
  3. At the time of his death the said deceased was possessed of property of the probable value of $6227.47.

          No probate of Will or Letters of Administration of the estate of said deceased have been previously applied for.

          Your Petitioner therefore prays that probate of the Will and codicil of the said James Brown deceased may be granted to him.

          And as in duty bound will ever pray.

I Kenneth Brown of Bishops Harbor in the Electoral District of Bonavista Bay, Fisherman, make oath and say:
That I believe the paper writing hereto annexed and marked by me to contain the true and original last Will and Testament and Codicil of James Brown, late of Bishops Harbor in the Electoral District of Bonavista Bay, deceased: That I am the Executor therein named and that I will well and faithfully administer the estate and effects of the testator  by paying his just debts and the legacies contained in his Will and by distributing the residue of the said estate, rights and credits according to law: and that I will exhibit under oath a true, full and perfect inventory of all and singular the estate and effects, rights and credits, of the testator and render a just and true account thereof whenever required by law so to do: that the testator died at Bishops Harbor aforesaid on the 19th day of October one thousand nine hundred and that the gross value of the estate and effects, rights and credits of the said testator is Six thousand five hundred and twenty seven 47/100 dollars, and no more, according to the best of my knowledge, information and belief.
