Notice

Three days from the date hereof application will be made to the Honorable the Supreme Court or one of the Honorable the Judges thereof for probate to the will of George Brown late of Kings Cove, Planter, deceased, to be granted to Jane Brown, widow of said deceased and George Brown of the same place, fisherman, the Executrix and Executor therein named.

I James Brown of Kings Cove, Bonavista Bay, Fisherman, make oath and say that on the seventh day of June A.D. One Thousand eight hundred and eighty? four, I was present and did see George Brown late of Kings Cove aforesaid, Fisherman, the Testator named in the paper writing hereunto annexed, marked A, duly sign, publish and declare the said annexed paper writing as and for his last Will and Testament, in my presence and in the presence of Joseph Brown of Kings Cove, aforesaid Fisherman the other subscribing witness thereto. That I and said Joseph Brown, then and there signed our names to such Will as such witnesses, in the presence of the said Testator and of each other and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

The petition of George Brown of Kings Cove, Bonavista Bay,

Humbly sheweth

  1. Your petitioner's father, George Brown, of Kings Cove, aforesaid, fisherman, and at that place on the 6th day of January 1899?, having made and published his last Will and Testament, hereto annexed duly proven
  2. That said testator left him surviving his widow, Jane Brown, two daughters, Clara, wife of Daniel Murphy, Elizabeth, wife of Thomas Fitzgerald and one son, your petitioner.
  3. At the time of his death, the said testator was possessed of property of the probable value of $500.
  4. The said testator appointed his wife, the said Jane Brown, Executrix, and your petitioner, Executor, of his said last Will and Testament.
  5. That no Probate or Administration has been granted to any Will or to the estate of said deceased.

          Your petitioner thereof prays that Probate to the said last Will and Testament of said deceased may be granted to him and the said Jane Brown.

          Dated at St. Johns this 1st day of December A.D. 1898.

I George Brown of Kings Cove in the Electoral District of Bonavista Bay, fisherman, make oath and say:
That I believe the paper writing hereto annexed and marked by me to contain the true and original last Will and Testament of George Brown late of Kings Cove in the Electoral District of Bonavista Bay, deceased : That I am one of the Executors therein named and that I will well and faithfully administer the estate and effects of the testator by paying his just debts and the legacies contained in his Will and by distributing the residue of the said estate, rights and credits according to law: and that I will exhibit under oath a true, full and perfect inventory of all and singular the estate and effects, rights and credits, of the testator and render a just and true account thereof whenever required by law so to do: that the testator died at Kings Cove, aforesaid, on the 6th day of January one thousand eight hundred and ninety seven and that the gross value of the estate and effects, rights and credits of the said testator is Five hundred dollars, and no more, according to the best of my knowledge, information and belief.

I George Brown of Kings Cove Bonavista Bay in the Northern District of the Island of Newfoundland Planter and Dealer do make and publish this my Last Will and Testament in manner following that is to say I give devise and bequeathe [sic] to my sons John and George all my wearing apparel in equal shares, also debts due to me in equal shares, also my stage stores boats nets and seines in equal shares, also I give devise and bequeath to my son George the large meadow and small garden next to the meadow also I give devise and bequeathe to my grandson William Stephen Brown the inside garden, also room enough to make a boat's fish on the fishing room herein before bequeathed to my two sons John and George provided always that he

the said William Stephen Brown shall stay on the room, and help to keep the fishing room in repair also I give devise and bequeathe to my wife Jane all the money which shall be left in the house after my funeral expenses are paid, also the ??? shop in which I have hitherto done business, also the western half of my dwelling house with all its contents, also the small new? store also the garden next to John's house, also the cellar in the garden, also the stable also half the small garden next to the stable, to have and to hold the above named property during the term of her natural life, and after the death of my wife, Jane Brown aforesaid then my will is that the several items bequeathed to her shall be distributed as follows namely the garden next to John's house to John's son Edward the stable and small garden to George's son Isaac George the bed in Will's room to Leonard son of George, also the old shop to George's son

Leonard, also the Western half of my dwelling house to my son George besides and in addition to the Eastern half of my dwelling house which I hereby give devise and bequeathe to my son George Brown aforesaid. Also I give devise and bequeathe to my wife Jane Brown all the contents of my old shop also all property not hereinbefore mentioned and bequeathed also all property of which I may die possessed whatsoever the same may be and wheresoever situate I do give devise and bequeathe the same to my wife Jane Brown aforesaid and my son George Brown aforesaid to be Executrix and Executor of this my last Will and Testament.
