Notice

Three days from the date hereof application will be made to the Honorable the Supreme Court or one of their Lordships, the Judges thereof for Probate to the last Will and Testament of Edward Botwood, late of St. Johns, Clerk in Holy Orders, deceased, to be granted to Isabella Botwood of the same place, Widow, the Executrix therein named.

This is the last Will and Testament of me, Edward Botwood, Clerk in Holy Orders, made this twenty first day of September, One thousand eight hundred and ninety seven. I hereby give, devise, and bequeath unto Isabella A. Winter, of Winterton, in S. Johns, Newfoundland, shortly to become my wife, all my personal and real estate whatsoever and wheresoever, to be held by her, her heirs and assigns for ever. I William Nixon of St. Johns, Labourer, make oath and say that on the 21st day of September A.D. One Thousand Eight Hundred and Ninety Seven, I was present and did see Edward Botwood late of St. Johns, Clerk in Holy Orders, the Testator named in the paper writing hereunto annexed marked A, duly sign, publish and declare the said annexed paper writing as and for his last Will and Testament, in my presence and in the presence of Charles Jeffreys, S.P.G. Missionary, the other subscribing witness thereto. That I and said Charles Jeffreys, then and there signed our names to such Will as such witnesses, in the presence of the said Testator and of each other, and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of my knowledge and belief.

TO THE HONORABLE THE SUPREME COURT OR ONE OF THE HONORABLE THE JUDGES THEREOF.

                              The Petition
of Isabella A. Botwood of St. Johns in the Island of Newfoundland, Widow.

Humbly Sheweth

  1. That Edward Botwood, late of St. Johns, Clerk in Holy Orders and Archdeacon of Newfoundland, died at that place on the 3rd of November inst. having made and published his last Will and Testament hereto annexed duly proven, to which he appointed then Isabella A. Winter Executrix.
  2. Said testator left him surviving his widow, your petitioner, two sisters, Elizabeth Botwood, and Matilda, wife of Revd. Charles Clarke, both resident in England, the widow and children of his brother, William Botwood, deceased, and Edith and Fanny Benson, children of a deceased brother, also resident in England.
  3. At the time of his death, the said testator was possessed of property of the probable value of $2200, as per schedule A on the other side hereof.

          No Probate or Administration has been granted to any Will or to the estate of said deceased.
Your petitioner therefore prays that Probate to the said last Will and Testament may be granted to her, the Executrix therein named.

In the Estate of Edward Botwood, DECEASED

I Isabella Amelia Botwood, of S. Johns, in the Electoral District of S. Johns, in the Island of Newfoundland, Widow, make oath and say that Edward Botwood, late of S. Johns, in the Electoral District of S. Johns in the Island aforesaid, deceased, died intestate; that I will well and faithfully administer the estate and effects, rights and credits of the said deceased, by paying his just debts and distributing the residue of estate and effects according to law; that I will exhibit a true and perfect Inventory of all and singular the said estate and effects, rights and credits, and render a just and true account thereof whenever required by law so to do; that the said deceased died at S. Johns aforesaid, on the third day of November one thousand nine hundred and one, that at the time of his death, the said deceased had a fixed place of abode in the Island aforesaid; and, that the gross value of the said estate and effects, rights and credits of the said deceased is Two thousand two hundred dollars and no more, according to the best of my knowledge, information and belief.

Know all Men by these Presents: That we, Isabella Amelia Botwood of S. Johns, Widow, James Branscombe of S. Johns, Accountant, and Joseph Outerbridge of S. Johns, Merchant, are jointly and severally bound unto our Lord Edward the Seventh by the Grace of God, of the United Kingdom of Great Britain and Ireland, King, Defender of the Faith, &c, in the sum of Four thousand four hundred dollars, to be paid to our said Sovereign Lord, the King, His Heirs and Successors for which payment well and truly to be made, we bind ourselves and each of us for the whole, our and each of our executors and administrators, firmly by these presents. Sealed with our seals.

Dated the 12th day of December in the year of our Lord 1901.

The Condition of this obligation is such that if the above named Isabella Amelia Botwood as administratrix of all the estate and effects, rights and credits of Edward Botwood, late of S. Johns in the Electoral District of S. Johns in the Island of Newfoundland deceased, (who died on or about the 3rd day of November A.D. 1901) do, when lawfully called on in that behalf, make, or cause to be made, a true and perfect inventory of all and singular the estate and effects, rights and credits of the said deceased, which have or shall come into the hands, possession or knowledge of her the said Isabella Amelia Botwood or into the hands or possession of any other person or persons for her and the same so made do exhibit, or cause to be exhibited, into the Registry of the Supreme Court of Newfoundland, whenever required by law so to do, and the same estate and effects, rights and credits, and all other estate and effects, rights and credits of the said deceased at the time of his death which at any time after shall come into the hands or possession of her the said Isabella Amelia Botwood or into the hands or possession of any other person or persons for her, do well and truly administer according to law, that is to say, do pay the debts which the said deceased did owe at his decease; and further, do make, or cause to be made, a just and true account of her said administration within twelve months from this date, or whenever required by law so to do, and all the rest and residue of the said estate and effects, rights and credits, do deliver and pay unto such person or persons respectively as shall be entitled thereto under any law now in force or that may hereafter be in force in Newfoundland; and if it shall hereafter appear that any last will and testament was made by the deceased and the executor or executrix therein named do exhibit the same unto the said Court, making request to have it allowed and approved accordingly, if the said Isabella Amelia Botwood, being thereunto required, do render and deliver the said letters of administration (approbation of such testament being first had and made) in the said Court, then this obligation to be void and of no effect, or else to remain in full force and virtue.

We James Branscombe of S. Johns, Accountant, and Joseph Outerbridge of S. Johns, Merchant, severally make oath and say:
That we are the proposed sureties on behalf of Isabella Amelia Botwood the intended administratrix of all and singular the estate and effects, rights and credits of Edward Botwood deceased, in the within bond named, for the faithful administration of the said estate and effects, rights and credits of the said deceased; and I the said James Branscombe, for myself make oath and say: that I am worth property to the amount of Two thousand two hundred dollars, over and above all incumbrances and over and above what will pay my just debts, and every other sum for which I am now bail, or for which I am liable as surety or endorser or otherwise, and I the said Joseph OuterBridge for myself make oath and say, that I am worth property to the amount of Two thousand two hundred dollars over and above what will pay my just debts and every other sum for which I am now bail or for which I am liable as surety or endorser or otherwise.
