NOTICE.

After three days from the date hereof, application will be made to the Honorable the Supreme Court or one of their Lordships, the Judges thereof, for Probate of the will of Thomas R. Bennett, late of Harbor Grace, Gentleman, deceased, to be granted to Jane Bennett, of Harbor Grace, Widow, the Executrix named in the said Will.
          Dated the 20th day of August, A.D. 1901

This is to certify that the notice on the other side hereof written has been posted in this office of the Chief Clerk and Registrar from the date thereof to this date and that no caveat or other objection has been made thereto.

The Petition of Jane Bennett of Harbor Grace in the Island of Newfoundland, Widow.

Humbly Sheweth

  1. That Thomas R. Bennett, of Harbor Grace in the Island of Newfoundland, Gentleman, died at Harbor Grace aforesaid, on the 12th day of August A.D. 1901.
  2. That hereto annexed is the last Will and Testament of said Thomas R. Bennett. That your petitioner was appointed Executrix thereof.
  3. That at the time of his death, the said Thomas R. Bennett was possessed of property and estate within the jurisdiction of Your Honorable Court of the probable value of less than Ten thousand dollars, and that hereto annexed is an inventory of the said property and estate.
  4. That the said Thomas R. Bennett left him surviving besides your petitioner, his widow, the following next of kin, viz:- Sarah Bennett, Margaret Bennett and Hannah Bennett, sisters, and ??? Bennett, Peter Bennett and James Bennett, brothers of the said deceased.
  5. That no application for Probate of the said Will or Administration of the Estate and effects of the said Thomas R. Bennett, has heretofore been made to your Honorable Court.

          Your petitioner therefore humbly prays that your Honorable Court or one of your Lordships, the Judges thereof, will be

pleased to grant unto her probate of the Will of the said Thomas R. Bennett.
          And as in duty bound, your Petitioner will ever pray.

I, Jane Bennett, of Harbor Grace, Newfoundland, widow, the Petitioner named in the foregoing petition, make oath and say that the several matters and things therein contained and set forth are correct and true, to the best of my knowledge and belief.

"A"

This is the last Will and Testament of me, Thomas R. Bennett, of Harbor Grace, lately Judge of the District Court, written with my own hand.
First - I will, give, and bequeath to my sisters, Sarah, Margaret, and Hannah, jointly, and to the survivors or survivor of them, the sum of Two thousand dollars ($ 2000).
Second - I will, give, and bequeath to my dear wife all the remainder of my estate, including houses and lands, goods and chattels, monies and securities for her sole use and benefit, subject to the following conditions that should any of the said Estate remain unspent at the time of death of my said wife, she shall leave the same to my nephew, William T. Bennett, and to my niece Clara Ott, in the proportion of two thirds to the said William T. Bennett, and one third to the said Clara Ott, and in the event of the death of either, before the death of my said Wife, then the share to go to his or her next of kin.
I nominate and appoint my wife as executrix to this will. In witness whereof I hereby set my hand at Harbor Grace, Nfland, this 15th day of February A.D. 1901.

St. John's To Wit
I William H. Horwood of Saint Johns, Newfoundland, Barrister at Law, make oath and say that on the 15th day of February A.D. One Thousand Nine Hundred and one, I was present and did see Thomas R. Bennett, late of Harbor Grace, Newfoundland, the Testator named in the paper writing hereunto annexed, marked A, duly sign, publish and declare the said annexed paper writing as and for his last Will and Testament, in my presence and in the presence of Alfred H. Seymour, the other subscribing witness thereto. That I and said Alfred H. Seymour, then and there signed our names to such Will as such witnesses, in the presence of the said Testator and of each other. That previously to the Will being so signed as aforesaid, by the said Testator and the said witnesses, it was read over to and approved of by, the said Testator in the presence of me and the said Testator and each other and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

I Jane Bennett of Harbour Grace in the Electoral District of Harbour Grace, widow, make oath and say:
That I believe the paper writing hereto annexed and marked by me to contain the true and original last Will and Testament of Thomas R. Bennett, late of Harbour Grace in the Electoral District of Harbour Grace, Judge of the District Court, deceased : That I am the executrix therein named, and that I will well and faithfully administer the estate and effects of the testator by paying his just debts and the legacies contained in his Will and by distributing the residue (if any) of the said estate, rights and credits according to law: and that I will exhibit under oath a true, full and perfect inventory of all and singular the estate and effects, rights and credits, of the testator and render a just and true account thereof whenever required by law so to do: that the testator died at Harbour Grace aforesaid on the 12th day of August one thousand nine hundred and one, and that the gross value of the estate and effects, rights and credits of the said testator is ten thousand dollars, and no more, according to the best of my knowledge, information and belief.
