deceased, to be granted to George M. Johnson? executor in the said will named.

The petition of George M. Johnson of St. Johns in the said Island, Solicitor,
Humbly Sheweth
- That William M. Bearns, late of St. Johns aforesaid, Gentleman, died in St. Johns on the nineteenth day of August instant (1900) having previously made his last will which is hereto annexed marked (A) of which will your petitioner is appointed executor.
- The said William M. Bearns left him surviving as next of kin his widow Elizabeth and the following (3) children Thomas Henry, Elizabeth Daly? and Ralph Patrick.
- The ??? hereto annexed marked (B) signed by your petitioner containing an inventory and valuation of the estate of the said late William M. Bearns at his decease.
- No letters of probate or said will or letters of administration to said estate have been granted.
- The Estate of the said late William M. Bearns at his death did not exceed $3500 in value, to the best of petitioner's belief.
Your petitioner prays that the said will may be admitted to probate and that he may be empowered with the execution thereof; and as in duty &c &c

I, George M. Johnson of St. Johns, aforesaid, solicitor, the executor named in the said will, and petitioner in the above written petition, make oath and say that the matters set out in the said petition are true to the best of my knowledge and belief, and that the above written inventory marked (B) is, to the best of my knowledge information and belief, a just and true inventory and valuation of the property of the said deceased at the time of his death, as far as I can at present ascertain.

This is the last will and testament of me, William M. Bearns, of St Johns, Newfoundland, Gentleman, and I hereby revoke all former wills by me made.
I give, devise and bequeath unto my dear wife, Elizabeth, that house in which I now live (No. 178), situate on the north side of Military Road, St. Johns and the land where on the same lands and the land appurtenant in rear of said house, also the right to use in common with the occupants of adjoining premises on the west that passage way which leads from Military Road by the East side of the said house. I also bequeath to my said wife all the furniture of what kind soever in or belonging to said house. I also bequeath to her those two pieces of land containing between one and two acres in all lying one on the East and the other on the West side of the Sand Pits Road which are at present occupied by ??? Bearns Senior as tenant and I hereby appoint George M. Johnson of St. Johns Solicitor executor of this my will,

I George M?? Johnson of St. Johns, in the Electoral District of St. John's Solicitor, make oath and say
That I am the executor therein named, and that I will well and faithfully administer the estate and effects of the testator by paying his just debts and the legacies contained in his Will so far as the same shall thereto extend and the law bind me, and by distributing the residue (if any) of the estate according to law; and that I will exhibit under oath a true, full and perfect inventory of all and singular the estate and effects, rights and credits, of the testator, and render a just and true account thereof whenever required by law so to do: that the testator died at St. John's aforesaid on the 19th day of August, one thousand nine hundred, and that the gross value of the estate and effects, rights and credits, of the said testator is three thousandand five hundred dollars, and no more, according to the best of my knowledge, information and belief.

I George M. Johnson of St. Johns, Solicitor, make oath and say that on the fourth day of August A.D. One Thousand Nine Hundred at St. John's I was present and did see William M. Bearns, late of St. Johns, aforesaid, Gentleman, deceased, the Testator named in the paper writing hereunto annexed marked A, duly sign, publish and declare the said annexed paper writing as and for his last Will and Testament, in my presence and in the presence of Thomas Bearns, of St. Johns, aforesaid, farmer? the other subscribing witness thereto. That I and said Thomas Bearns, then and there signed our names to such Will as such witnesses, in the presence of the said Testator and of each other, and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of my knowledge and belief.
