In the Supreme Court of Newfoundland

NEWFOUNDLAND
St. Johns To Wit:          I Terence Stafford of St. Johns, aforesaid, Gentleman, do swear that I believe that William Stafford, late of St. Johns, aforesaid, Gentleman, deceased, died without a Will; and that I will well and truly administer all and every the Goods of the said deceased and pay his debts, so far as his Goods will extend and the law shall bind me, and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within six months from the date hereof, or when I shall be thereunto lawfully required; and that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased of which he died possessed, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of Two thousand dollars.

To the Honourable the Supreme Court of Newfoundland, or to one of the honourable Judges thereof.

The Petition of Terence Stafford of Saint Johns in the Island aforesaid, Gentleman.

Humbly Sheweth, that:

  1. Your Petitioner's brother, William Stafford, of Saint Johns aforesaid, Gentleman, died at that place, intestate, on or about the Nineteenth day of February last past.
  2. The said William Stafford left him surviving his brother, Terence Stafford, your Petitioner, and four children of his deceased sister, Elizabeth Kavanagh, namely Elizabeth, widow of the late James O'Flaherty, Margaret, Wife of James Forman, Laurence Kavanagh, and John Kavanagh.
  3. The said Laurence Kavanagh and the said John Kavanagh, do not reside within the jurisdiction of this Honourable Court.
  4. At the time of his death, the said William Stafford was possessed of property of the probable value of Two thousand dollars.
  5. No Administration to the Estate of the said William Stafford has been granted forth

    of your Honourable Court to any one.

          Your Petitioner therefore prays that Letters of Administration to the Estate of the said William Stafford be granted to him.
          And as in duty bound Your Petitioner will ever pray &c  &c  &c

Be it Remembered That on this 6th day of March in the 63rd Year of the Reign of our Sovereign Lady Victoria, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, and in the Year of our Lord One Thousand Nine Hundred personally appeared Terence Stafford of S. Johns, Gentleman, and Andrew Connors of St. Johns, manufacturer, and  James Warren, of S. Johns, Hardware Merchant, and did acknowledge themselves to be held and firmly bound to our said Sovereign Lady the Queen, Her Heirs and Successors, in the penal Sum of Four thousand dollars to be had, made and levied on his Goods, Chattels and Effects, jointly and severally, if Default is made in any of the conditions following :---

Now the Condition of this Obligation is such, that if the above bounden Terence Stafford as Administrator of the Estate and Effects of William Stafford, late of S. Johns, aforesaid, Gentleman, deceased, do make or cause to be made, a just, true, and perfect inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of him the said Terence Stafford as such Administrator or to the hands or possession of any other person, or persons, for him and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the 5th day of September next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come into the hands or possession of him the said Terence Stafford, or to the hands or possession of any other person or persons for him shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of his said Administration, on or before the 5th day of March which will be in the Year of Our Lord One Thousand nine hundred and one, and afterwards from time to time as he shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force and virtue.

IN THE SUPREME COURT OF NEWFOUNDLAND

In the Estate of William Stafford, late of S. Johns, Gentleman, deceased we severally make oath and say:

          WE, Andrew Connors of S. Johns in the Central District of Newfoundland, Manufacturer, and James Warren of S. Johns, Hardware Merchant, in the District of Newfoundland.
          THAT we are the proposed sureties on behalf of the intended administrator of the property of William Stafford, late of S. Johns, aforesaid, Gentleman, deceased, in the within bond named, for the faithful administration of the said estate and effects, rights and credits of the said deceased; and I the said Andrew Connors of St. Johns, manufacturer, in the Central District, make oath and say: that I reside at S. Johns and am worth property to the amount of Four thousand dollars, over and above all incumbrances and over and above what will pay my just debts, and every other sum for which I am now bail, or for which I am liable as surety or endorser or otherwise,
          AND I the said James Warren for myself make oath and say, that I reside at S. Johns and am worth property to the amount of Four thousand dollars over and above all encumbrances and over and above what will pay my just debts and every other sum for which I am now bail or for which I am liable as surety or endorser or otherwise.
