NEWFOUNDLAND
St. Johns To Wit:          I James Squires of Saint Johns, Labourer do swear that I believe that Israel Squires late of St. Johns, aforesaid, labourer, deceased, died, and I am informed and believe, with a will which cannot be found; and that I will well and truly administer all and every the Goods of the said deceased and pay his debts, so far as his Goods will extend: and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within six months from the date hereof, or when I shall be thereunto lawfully required; and that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased of which he died possessed, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of One hundred and fifty dollars.

So help me God

Be it Remembered That on this 30th day of May in the 63rd Year of the Reign of our Sovereign Lady Victoria, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, and in the Year of our Lord One Thousand Nine Hundred personally appeared James Squires of S. Johns, Labourer, Charles W. H. Tessier of same place, Merchant, and John Rowe of same place, Accountant, and did acknowledge themselves to be held and firmly bound to our said Sovereign Lady the Queen, Her Heirs and Successors, in the penal sum of Three hundred dollars to be had, made and levied on their Goods, Chattels and Effects, jointly and severally, if Default is made in any of the conditions following :---

Now the Condition of this Obligation is such, that if the above bounden James Squires as Administrator of the Estate and Effects of Israel Squires, late of Saint Johns, Labourer, deceased, do make or cause to be made, a just, true, and perfect inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of him the said James Squires, as such Administrator or to the hands or possession of any other person, or persons, for him and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the 30th day of November next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come into the hands or possession of him the said James Squires, or to the hands or possession of any other person or persons for him shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of his said Administration, on or before the 30th day of which will be in the Year of Our Lord One Thousand nine hundred and one, and afterwards from time to time as he shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force and virtue.

In the matter of the estate of
Israel Squires deceased,

We Charles W. H. Tessier of S. Johns, Merchant, in the Central District of Newfoundland, and John Rowe of same place in the Central District of Newfoundland, severally make oath and say:
That we are the proposed sureties on behalf of the intended administrator of the property of Israel Squires deceased, in the within bond named, for the faithful administration of the said property of the said deceased; and I the said Charles W. H. Tessier of St. Johns, in the said District, make oath and say that I reside in St. Johns and am worth property to the amount of Nine hundred dollars, over and above all encumbrances and over and above what will pay my just debts, and every other sum for which I am now bail, or for which I am liable as surety or endorser or otherwise, and I the said John Rowe, make oath and say, that I reside at St. Johns and am worth property to the amount of Nine hundred dollars, over and above what will pay my just debts, and every other sum for which I am now bail and for which I am liable as surety or endorser or otherwise.

To the Honourable Supreme Court of Newfoundland or to one of the Honourable Judges thereof.

The petition of James Squires of Saint Johns in the Island of Newfoundland, Labourer,

Humbly Sheweth

  1. That Israel Squires late of Saint Johns aforesaid, Labourer, deceased, died there on or about the 9th day of April A.D. 1895, leaving him surviving as next of kin, his widow, Johanna Squires, and four children viz: Richard, Elizabeth, Nora and your petitioner.
  2. The said Johanna Squires is of unsound mind and is confined in the Lunatic Asylum at Saint Johns. The said Nora Squires died unmarried about one year after the death of the said Israel Squires. The said Elizabeth Squires now resides at or near Halifax in the Dominion of Canada.
  3. At the time of his death the deceased was possessed of property within the jurisdiction of your Honourable Court of the probable value of $150.00.
  4. No probate of any will nor administration to the Estate of said deceased has been granted to any person.
  5. That I am informed and believe that before his death the said Israel Squires executed his last will and testament.
  6. That I have made a diligent search and inquiry for the said will but have been unable to find the same or discover in whose possession the same is.

  7. That one of the subscribing witnesses to said will, Stephen Butler, of Saint Johns, Ship's Carpenter, has informed me that he believes that by the said will, the said Israel Squires left all his estate to the said Johanna Squires.
  8. That I cannot discover who was the other subscribing witness to said will, or who prepared the same or who the executor or executors thereof (if any) are.

          Petitioner therefore prays that letters of Administration to the Estate of deceased may be granted to him.
          And as in duty bound he will ever pray etc.
          Dated at Saint Johns this 24th day of May A.D. 1900.

Petition for Administration

I am informed by the Solicitor for Petitioner that the whole Estate of the alleged intestate consists of a leasehold interest in land with dwelling house thereon and that a considerable Sum is due thereon for ground rent. In view of this and of the smallness of the Estate I think it would be inadvisable to put the parties to the Expense of Citation proceedings. The evidence as to the alleged lost will is also so meagre that it will not justify my ordering proceedings to be taken for further enquiry touching this will. I therefore treat the Estate as an intestate Estate and order that administration be granted to the petitioner upon her furnishing the usual security.
