NEWFOUNDLAND
Saint Johns To Wit:
I John Scott of Saint Johns, Saddler, do swear that I believe that William Scott of Saint Johns, Grocer and Provision Dealer, deceased, died with a Will; and that I will well and truly administer all and every the Goods of the said deceased and pay his debts, so far as his Goods will extend: and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within six months from the date hereof, or when I shall be thereunto lawfully required; and that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased of which he died possessed, and was unadministered, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of One thousand dollars.

So help me God

Three days after date hereof application will be made to the Honorable the Supreme Court of Newfoundland or one of the Honorable Judges thereof for Letters of Administration de bonis non to the Estate of William Scott late of St. Johns, Licensed Dealer, deceased to be granted to John Scott, son of deceased.

To the Honorable the Supreme Court or one of the Honorable Judges thereof.

The Petition of John Scott of Saint Johns in the Island of Newfoundland, Saddler.

Humbly Sheweth

  1. That William Scott, late of Saint Johns, Grocer and Provision Dealer, died at that place about or in the 1892 having made a will of which Probate was granted to Thomas Summers, of St. Johns, one of the Executors named therein.
  2. That the said Thomas Summers having died without a Will in the month of July 1892, Patrick J. Scott of St. Johns ??? a son of deceased, made an application to your Honorable Court for Letters of Administrationc.t.a., d.b.n. and a Fiat was given on said application by Sir F.B.T. Carter, late Chief Justice of the Supreme Court, but the papers remained incomplete and no Letters of Administration issued to said Patrick J. Scott.
  3. That the said Patrick J. Scott acted as Administrator of said Estate of William Scott and partially administered the same.
  4. That the said estate consists of Leasehold property in Water Street now under Lease to one Jane McKay.
  5. That the probable value of said Estate

    does not now exceed $1000.00.
  6. That your Petitioner is a son of said William Scott, deceased and that the only other next of kin now alive are Ellen Scott, Bridget Scott, wife of W. R. McDougall and Edward Scott, all with the exception of your Petitioner resident without the jurisdiction of your honorable Court.
  7. That Patrick J. Scott left a widow, Ellen Scott.
  8. That Patrick J. Scott died without fully administering the Estate of said William Scott
  9. Your Petitioner therefore prays that your Lordships may be pleased to grant him Letters of Administration de bonis non, cum testamento annexo to the Estate of said William Scott.
  10. And as in duty bound will ever pray

Be it Remembered That on this 5th day of December in the 63rd Year of the Reign of our Sovereign Lady Victoria, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, and in the Year of our Lord One Thousand Eight Hundred and Ninety Nine, personally appeared John Scott of Saint Johns, Saddler, Charles Gamberg of same place, Painter, and Michael Myrick, of same place and did acknowledge themselves to be held and firmly bound to our said Sovereign Lady the Queen, Her Heirs and Successors, in the penal Sum of Two thousand dollars to be had, made and levied on his Goods, Chattels and Effects, jointly and severally, if Default is made in any of the conditions following :---

Now the Condition of this Obligation is such, that if the above bounden John Scott as Administratord.b.n.: c..t.a. of the Estate and Effects of William Scott late of Saint Johns, Grocer & Provision Dealer, deceased, do make or cause to be made, a just, true, and perfect inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of him the said John Scott, as such Administrator or to the hands or possession of any other person, or persons, for him and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the 5th day of June next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come into the hands or possession of him the said John Scott or to the hands or possession of any other person or persons for him shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of his said Administration, on or before the 5th day of December, which will be in the Year of Our Lord One Thousand nine hundred and one, and afterwards from time to time as he shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force and virtue.
