In the Estate of Thomas Ryan late of St. Johns, deceased, Pilot,
We Archibald MacPherson of St. Johns in the Electoral District of St. Johns, Merchant, and Martin O'Flannagan of same place, Draper, severally make oath and say: That we are the proposed sureties on behalf of the intended administratrix, with the will annexed, of all and singular the estate and effects, rights and credits, of Thomas Ryan, late of St. Johns, Pilot, deceased, in the within bond named, for the faithful administration of the said estate and effects, rights and credits, of the said deceased; and I the said          for myself make oath and say that I am worth property to the amount of one thousand dollars, over and above all encumbrances and over and above what will pay my just debts, and every other sum for which I am now bail, or for which I am liable as surety or endorser or otherwise, and I the said          for myself, make oath and say, that I am worth property to the amount of One thousand dollars, over and above what will pay my just debts, and every other sum for which I am now bail and for which I am liable as surety or endorser or otherwise.

Martin O'Flannagan were sworn before me,
this 13th day of June A.D. 1900 at St. Johns                         Martin O'Flannagan

Know all Men by these Presents: That we Mary Ann Dudley of St. Johns, Widow, Archibald MacPherson of St. Johns, Merchant, and Martin O'Flannagan of St. Johns, Draper, are jointly and severally bound unto our Sovereign Lady Victoria by the Grace of God, of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, in the sum of One thousand dollars, to be paid to our said Sovereign Lady the Queen, Her Heirs and Successors for which payment well and truly to be made, we bind ourselves and each of us for the whole, our and each of our executors and administrators, firmly by these presents. Sealed with our seals.

Dated the 13th day of June in the year of our Lord 1900.

The Condition of this obligation is such that if the above named Mary Ann Dudley as administratrix of all the estate and effects, rights and credits of Thomas Ryan of St. Johns in the Electoral District of St. Johns East in the Island of Newfoundland, Pilot, deceased, (who died on or about the          day of A.D. 1874 do, when lawfully called on in that behalf, make, or cause to be made, a true and perfect inventory of all and singular the estate and effects, rights and credits of the said deceased, which have or shall come into the hands, possession or knowledge of her the said Mary Ann Dudley or into the hands or possession of any other person or persons for her and the same so made do exhibit, or cause to be exhibited, into the Registry of the Supreme Court of Newfoundland, whenever required by law so to do, and the same estate and effects, rights and credits, and all other estate and effects, rights and credits of the said deceased at the time of his death which at any time after shall come into the hands or possession of her the said Mary Ann Dudley or into the hands or possession of any other person or persons for her, do well and truly administer according to law, that is to say, do pay the debts which the said deceased did owe at his decease; and further, do make, or cause to be made, a just and true account of his said administration within twelve months from this date, or sooner if thereunto required, and all the rest and residue of the property shall deliver and pay unto such person or persons as shall be by law entitled thereto; then this obligation to be void and of no effect, or else to remain in full force and virtue.

Upon reading the Petition herein and the writ and statement of claim which was ordered to be issued herein and upon hearing Mr. McNeily Q.C. for Plaintiff and Mr. Wood for defendant and by Consent of parties, it is ordered that Administration with the will annexed to the Estate of the said Thomas Ryan be granted to the said Mary Anne Dudley in respect to the Estate of the said Thomas Ryan not administered upon the usual security being given by her.

After three days application will be made to the Honourable Supreme Court or to a Judge thereof for Administration de bonis non administratis of the Estate of Thomas Ryan late of St. Johns, Pilot, to be granted to Donald M. Browning Esquire, Q. C. or such other person as the Court may appoint.

The Petition of Archibald MacPherson of St. Johns in the said Island, Merchant.

Humbly Sheweth

          That Thomas Ryan formerly of St. Johns, Pilot, died in the year 1874, leaving him surviving his widow, Mary Ann Ryan and three sons, John, Thomas, and Samuel and one daughter, Mary Ann Dudley.
          That said Thomas Ryan died intestate and administration of his Estate was granted to said Mary Ann Ryan.
          That said Mary Ann Ryan during her lifetime as Administratrix of said Thomas Ryan devised to one John H. Boone, since deceased, a certain dwelling house, land and premises situate on Queen's Road in St. Johns, of which Petitioner has by mesne? assignments become the present lessee and assignee.
          That the said Mary Ann Ryan Administratrix as aforesaid, died without having fully administered the Estate of the said Thomas Ryan and the said Estate is now without a legal representative.
          That in the conveyance from said Mary Ann Ryan as Administratrix, there is a Covenant? for

further assurance of the premises conveyed? to the said John Boone and his assigns.
          That Petitioner requires and as he is advised is entitled to further assurance in the premises? which can only be given by the representative of the Estate of said Thomas Ryan.
          That since the decease of said Mary Ann Ryan no Probate or Administration has been granted or applied for in respect of the Estate of the said Thomas Ryan, the value of which Petitioner does not know.
          Your Petitioner therefore prays that Administration de bonis non administrates to the Estate of the said Thomas Ryan may be granted to Donald M. Browning Esquire, Chief Clerk and Registrar of this Honourable Court or to such other person as the Court may adjudge.
          And Petitioner as in duty bound will ever pray &c

NEWFOUNDLAND
St. Johns To Wit:          I Mary Ann Dudley of St. Johns, Widow, do swear that I believe that Thomas Ryan late of St. Johns, Pilot, deceased, died with a Will; and that I will well and truly administer all and every the Goods of the said deceased and pay his debts, so far as his Goods will extend: and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within six months from the date hereof, or when I shall be thereunto lawfully required; and that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased of which he died possessed, now unadministered, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of Five hundred dollars.

So help me God
