Notice

After three days from the date hereof application will be made to the Honorable the Supreme Court of Newfoundland or to one of the Honorable Judges thereof, for Letters of Adminis-tration cum testamento annexo to the Estate and Will of Thomas Rose of Belloram, Fortune Bay, in the Island aforesaid, Fisherman, deceased, to be granted to Robert Rose, son of said deceased.

A

Knowing that it is appointed unto all men once to die, I hereby bequeath to my sons, George Samuel Rose and Robert Rose conjointly my fishing stage at Belloram. I bequeath to my son, George Samuel Rose, my flakes and Beach, my Garden on the hill near the Cross Roads ??? to St. Jacques and my garden surrounding his house inside the present fence. I bequeath half my garden situated in front of my son Robert's house to my grand daughter Rachel Rose and the other half to my said son, Robert Rose. My other land not already named at present (in possession of my other sons and daughter I give and bequeath to them respectively.

I Arthur G. Cunningham, of Belloram, Preventive? Officer, make oath and say that on the 29th day of December A.D. One Thousand Eight Hundred and Ninety Eight? at Belleoram, I was present and did see Thomas Rose late of Belleoram in the Island aforesaid, the Testator named in the paper writing hereunto annexed, marked A, duly sign (by making his mark), publish and declare the said annexed paper writing as and for his last Will and Testament, in my presence and in the presence of Levi A. McCuish of Belleoram, Merchant, the other subscribing witness thereto. That I and said Levi A. McCuish then and there signed our names to such Will as such witnesses, in the presence of the said Testator and of each other. That previously to the Will being so signed as aforesaid, by the said Testator and the said witnesses, it was read over to and approved of by, the said Testator in the presence of me and the said Levi A. McCuish and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

The Petition of George Samuel Rose of Belleoram, Fortune Bay in the Island aforesaid, Fisherman.

Humbly Sheweth

That Thomas Rose, your petitioner's father, died at Belleoram aforesaid about the month of May, AD, 1897, having previously made and executed his will (hereto annexed) marked A, to which he did not appoint an executor or executors.
That the said deceased left him surviving the following next of kin, namely :-
John, since dead, leaving wife and four children, Robert, (since dead) leaving wife and four children, Levi, living but (non compos mentis) Your petitioner and one sister (wife of Thomas Grandy.

That said deceased at the time of his death was possessed of property in the jurisdiction of this Honourable Court of the probable value of Two hundred dollars.
That no probate of any will nor administration to the Estate of the said deceased has hitherto been applied for by or granted to any person.
Your Petitioner therefore prays that Letters of Administration with the Will annexed may be granted to him.
And as in duty bound your petitioner will ever pray &c

Be it Remembered That on this 29th day of December in the 60?th Year of the Reign of our Sovereign Lady Victoria, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, and in the Year of our Lord One Thousand Eight Hundred and ninety nine

Personally appeared George Samuel Rose of Belleoram, Fisherman, John R ??? ??? of ships, Belleoram and Levi T. Cluett, Merchant? and did acknowledge themselves to be held and firmly bound to our said Sovereign Lady the Queen, Her Heirs and Successors, in the penal sum of four hundred dollars to be had, made and levied on their Goods, Chattels and Effects, jointly and severally, if Default is made in any of the conditions following :---

Now the Condition of this Obligation is such, that if the above bounden George Samuel Rose, of Belleoram aforesaid as Administrator of the Estate and Effects of Thomas Rose late of Belleoram, Fortune Bay, in the Island aforesaid, Fisherman, deceased, do make or cause to be made, a just, true, and perfect inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of him the said George Samuel Rose as such Administrator or to the hands or possession of any other person, or persons, for him and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the 30th day of June next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come into the hands or possession of him the said George Samuel Rose or to the hands or possession of any other person or persons for him shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of his said Administration, on or before the 29th day of December which will be in the Year of Our Lord One Thousand nine hundred and afterwards from time to time as he shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force and virtue.

St. Jacques To Wit:          I George Samuel Rose of Belleoram, Fortune Bay in the Island aforesaid, Fisherman, do swear that I believe that Thomas Rose late of Belleoram aforesaid, Fisherman deceased, died with a Will; and that I will well and truly administer all and every the Goods of the said deceased and pay his debts, so far as his Goods will extend: and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within six months from the date hereof, or when I shall be thereunto lawfully required; and that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased of which he died possessed, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of Two hundred dollars.
