In the Estate of Jeremiah Rose deceased
I John Joseph Rose of Little Bay West, in the Electoral District of Fortune Bay in the Island of Newfoundland, Merchant, make oath and say that Jeremiah Rose late of Little Bay West, in the Electoral District of Fortune Bay in the Island aforesaid, deceased, died intestate; that I will well and truly administer the estate and effects, rights and credits of the said deceased and pay his debts, so far as his Goods will extend: and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a just and true account thereof whenever required by law so to do; that the said deceased died at Little Bay West aforesaid on the eighth day of December One thousand eight hundred eighty four, that at the time of his death, the said deceased had a fixed place of abode in the Island aforesaid; and, that the gross value of the said estate and effects, rights and credits of the said deceased is One thousand nine hundred and eighty dollars and no more, according to the best of my knowledge, information and belief.

Herewith please find Papers in-re Estate of Jeremiah Rose deceased duly executed.
I be [sic] submit the name of Thomas White Jersey Harbor, Fortune Bay, Schooner owner and Planter and one of the most independent men in Fortune Bay, as a Bond man for Administrator in-re said Estate in conjunction with Maria Rose, Widow, ??? ??? Rose Lee? Son in the event of letters of Administration being granted to John Joseph Rose.
As G??? Rose is anxious to proceed to Sydney in his Schooner and as he is desirous of executing the Bond before his departure, please forward that document to me without fail by Mail Steamer at her next trip and oblige [sic]

We George Rose of Little Bay West in the Electoral District of Fortune Bay, Merchant, Maria Rose of same place, Widow, and Thomas White of Jersey Harbor in Fortune Bay, Planter severally make oath and say:
That we are the proposed sureties on behalf of John Joseph Rose the intended administrator, C.T.A. of all and singular the estate and effects, rights and credits, of Jeremiah Rose, deceased, in the within bond named, for the faithful administration of the said estate and effects, rights and credits, of the said deceased; and I the said George Rose for myself make oath and say that I am worth property to the amount of Four thousand dollars, over and above all incumbrances and over and above what will pay my just debts, and every other sum for which I am now bail, or for which I am liable as surety or endorser or otherwise, and we the said Maria Rose and Thomas White for ourselves, make oath and say, that we are severally worth property to the amount of Four thousand dollars, over and above what will pay my just debts, and every other sum for which I am now bail and for which I am liable as surety or endorser or otherwise.

I William Stewart Clerk, Little Bay West in the Electoral District of Fortune Bay make oath and say that I was present and did see the within Bond duly executed by the parties named therein: and that the name William Stewart set and subscribed as a witness thereto, is of the proper handwriting of me, this deponent, and that the same was executed at Little Bay West in the Electoral District of Fortune Bay on the 14th day of November A.D. 1900

Know all Men by these Presents: That we John Joseph Rose of Little Bay West in the Electoral District of Fortune Bay, Merchant, George Rose of same place, Merchant, Maria Rose of same place, Widow, and Thomas White, of Jersey Harbor in Fortune Bay, Planter, are jointly and severally bound unto our Sovereign Lady Victoria by the Grace of God, of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, in the sum of Four thousand dollars, to be paid to our said Sovereign Lady the Queen, Her Heirs and Successors for which payment well and truly to be made, we bind ourselves and each of us for the whole, our and each of our executors and administrators, firmly by these presents. Sealed with our seals.

Dated the 14th day of November in the year of our Lord 1900.

The Condition of this obligation is such that if the above named John Joseph Rose as administrator C.T.A. of all the estate and effects, rights and credits of Jeremiah Rose late of Little Bay West in the Electoral District of Fortune, Merchant, in the Island of Newfoundland deceased, (who died on or about the eighth day of December A.D.1894) do, when lawfully called on in that behalf, make, or cause to be made, a true and perfect inventory of all and singular the estate and effects, rights and credits of the said deceased, which have or shall come into the hands, possession or knowledge of him the said John Joseph Rose, or into the hands or possession of any other person or persons for him and the same so made do exhibit, or cause to be exhibited, into the Registry of the Supreme Court of Newfoundland, whenever required by law so to do, and the same estate and effects, rights and credits, and all other estate and effects, rights and credits of the said deceased at the time of his death which at any time after shall come into the hands or possession of him the said John Joseph Rose or into the hands or possession of any other person or persons for him, do well and truly administer according to law, that is to say, do pay the debts which the said deceased did owe at his decease, and further, do make, or cause to be made, a full true and just account of his said administration within twelve months from this date, or whenever required by law so to do, deliver and pay unto such person or persons respectively as shall be entitled thereto under any law now in force or that may hereafter be in force in Newfoundland: and if it shall hereafter appear that any last will and testament was made by the deceased, and the executor or executors therein named do exhibit the same unto the said court, making request to have it allowed and approved accordingly, if the said John Joseph Rose being thereupon required, do render and deliver the said letters of administration (approbation of such testament being first had and made) in the said Court, then this obligation to be void and of no effect, or else to remain in full force and virtue.

I, Jeremiah Rose of Little Bay West, Fortune Bay, Newfoundland, Fisherman & Planter, being of sound mind but weak in body, and knowing that it is appointed unto all men once to die, do make this my last Will and Testament - I desire that all my just debts and funeral expenses be paid and then I give and bequeath the Schooner and all the fishing gear, boats, seines and nets with fish stores to my two sons, George & John Joseph, equally; on condition that they support and maintain in comfort my other son; their brother, Levi Thomas, and their three sisters, Eliza Charity, Elizabeth and Clara; so long as they remain within my house and land. I give to my dear wife, Maria, for her life time, and at her death, to my said two sons, George and John Joseph equally - I give to my dear wife Maria, all the cattle and sheep I possess, with one hundred pounds, being money non [sic] in hand - I leave my said wife, Maria, residuary legatee and appoint the Rev. William K. Little Bay West, to wit.          I William Stewart of Little Bay West, aforesaid, make oath and say that I was present and did see Maria Rose and George Rose the parties named in the consent hereto annexed (marked C) duly sign the same by making their marks, in my presence on the 15th day of October One thousand nine hundred, and I duly attested their Executors thereof.

The Petition of John Joseph Rose of Little Bay West, Fortune Bay, Newfound- land, Merchant.

Humbly Sheweth

That Your Petitioner's father, Jeremiah Rose, late of Little Bay West, aforesaid, Planter, died there on the 28th day of December 1884, having previously made his last Will and Testament, a copy of which is hereto annexed, marked A, whereby he appointed the Reverend William K. White of Harbor Britain and Jesse Thornton? of Little Bay West aforesaid, executors thereof.
That the said Reverend K. White died at Harbor Briton aforesaid on the 29th day of May 1886.
That Probate of the said Will was granted to the said Jesse Thornton on the 15th July 1887.
That the said Jesse Thornton departed from and has remained absent from this Colony for some years and is now residing in Highland and has not appointed an attorney

to act for and represent him.
That the interests of parties contained in the Estate and will be prejudiced by the absence of the said Executor.
That Levi Thomas Rose, mentioned in the said Will, is a member of your petitioner's firm. "I. I. Rose and Mothers?" of Little Bay West aforesaid, Merchants and your Petitioners sisters Eliza Charity, Elizabeth and Clara, also mentioned in the said Will, are comfortably married and settled in homes of their own.
That at the time of Testator's decease, he was possessed of property of the probable value of two thousand dollars within the jurisdiction of your Honorable Court as per schedule, hereto annexed marked B.
That the said Consent hereto annexed marked C, is the consent of the legatees under the said Will.
Petitioner therefore prays that your Lordships will be pleased to grant him Letters of Administration with the Will annexed of the Estate of the said late Jeremiah Rose.
And as in duty bound will ever pray &c.
