Notice

After three days application will be made to the Honorable Supreme Court or one of the Honorable Judges thereof for Letters of Ad-ministration to the Estate of the late Patrick O'Brien of Aquaforte in the Southern District Planter, deceased, to be granted to Thomas O'Brien of St. Johns, Shoemaker.
          Dated at St. Johns this 28th September A.D. 1900.

Be it Remembered That on this 24th day of January in the 63rd Year of the Reign of our Sovereign Lady Victoria, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, and in the Year of our Lord One Thousand Nine Hundred personally appeared John Anderson of St. Johns, Merchant, John Jackson also of same place, Merchant, and Henry Conan of St. Johns, Accountant, and did acknowledge themselves to be held and firmly bound to our said Sovereign Lady the Queen, Her Heirs and Successors, in the penal Sum of One thousand dollars to be had, made and levied on his Goods, Chattels and Effects, jointly and severally, if Default is made in any of the conditions following :---

Now the Condition of this Obligation is such, that if the above bounden John Anderson as Administrator of the Estate and Effects of Patrick O'Brien late of Aquaforte in the Southern District Planter deceased, do make or cause to be made, a just, true, and perfect inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of him the said John Anderson as such Administrator or to the hands or possession of any other person, or persons, for him and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the 24th day of July next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come into the hands or possession of him the said John Anderson or to the hands or possession of any other person or persons for him shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of his said Administration, on or before the 24th day of January which will be in the Year of Our Lord One Thousand nine hundred and one and afterwards from time to time as he shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force and virtue.

The Petition of Thomas O'Brien of Saint Johns, Shoemaker

Humbly sheweth

That your Petitioner's late father, Patrick O'Brien of Aquaforte, Planter, died at Saint Johns aforesaid on the Seventeenth day of August one thousand eight hundred and ninety two without having made a Will and leaving him surviving two sons and five daughters, namely, your Petitioner, the eldest, and Patrick residing at Aquaforte aforesaid, Mary, married to Edward Larkin, Esther, married to Henry Devereaux, Kate, married to Patrick Hogan, all residing in Saint Johns, aforesaid, Theresa, married to William Woods, residing at Charlevoix, Michigan, United States of America, Agnes, married to William Cahill, residing at Chicago, United States of America.
That at the time of his death, the deceased was possessed of property of the probable value of Five hundred dollars.
That neither Probate nor Administration has been previously granted to the Estate of the said deceased.

Petitioner therefore prays that Your Lordships will be pleased to grant him Letters of Administration to the Estate of the said Patrick O'Brien.

I Mary Larkin of Saint Johns married woman do hereby consent to Letters of Administration to the estate of my father Patrick O'Brien of Aquaforte, Southern District, Planter, deceased, being granted to my eldest brother, Thomas O'Brien, of St. Johns, aforesaid, Shoemaker.

          Let all parties concerned in the Administration of the estate of the above named deceased attend before me in Chambers at the Court House in St. Johns on Saturday the 16th day of December instant at ten o'clock a.m. upon the application of Thomas O'Brien, eldest son of said deceased who claims an order for administration of the said estate to be granted to him.
          If you do not attend in person or by solicitor at the time and place above mentioned, such order will be made and proceedings taken as may be just and expedient.

St. Johns To Wit:          I John Anderson of St. Johns aforesaid Merchant do swear that I believe that Patrick O'Brien late of Aquaforte in the Southern District Planter deceased, died without a Will; and that I will well and truly administer all and every the Goods of the said deceased and pay his debts, so far as his Goods will extend: and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within six months from the date hereof, or when I shall be thereunto lawfully required; and that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased of which he died possessed, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of Five hundred dollars.
