NEWFOUNDLAND
To Wit
I Patrick Fenelly of Fermeuse Planter do swear that I believe that Catherine Murphy late of Fermeuse Widow deceased, died without a Will; and that I will well and truly administer all and every the Goods of the said deceased and pay her debts, so far as her Goods will extend: and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within six months from the date hereof, or when I shall be thereunto lawfully required; and that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased of which she died possessed, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of Eight hundred dollars.

So help me God

The Petition of Mary Murphy of Fermeuse Telegraph Operator

Humbly Sheweth

That Catherine Murphy late of Fermeuse in the Southern District of Newfoundland widow died at that place on or about the 16th day of August 1899 intestate.
That the said Catherine Murphy left her surviving one daughter your petitioner as her sole next of kin.
That at the time of her death the said Catherine Murphy was possessed of and entitled to property within the Jurisdiction of this Honourable Court of the probable value of Eight hundred dollars, as set forth in the schedule hereto annexed marked A and signed by your petitioner.
That no probate of a will or administration to the estate of the said Catherine Murphy may be granted to Patrick Fenelly of Fermeuse aforesaid, Planter, a cousin of your petitioner, and as in duty bound she will ever pray.

  1. I am the petitioner in the foregoing perition named
  2. The several matters and things therein contained are just correct and true
  3. The schedule to the said petition marked "A" and signed by me to the best of my knowledge information and belief contains a full and true inventory and valuation of the property of which the said Catherine Murphy was possessed and to which she was entitled at the time of her death, as far as I can at present ascertain.

We J. J. Windsor JP of Ferryland in the Southern District of Newfoundland and John Morry of Fermeuse in the Southern District of Newfoundland severally make oath and say that we are the proposed sureties on behalf of the intended Administrator of the property of Catherine Murphy deceased in the within bond named for the faithful administration of the said property of the said deceased and I the said J. J. Windsor of Ferryland in the Southern District make oath and say: That I reside at Ferryland and am worth property to the amount of Sixteen hundred dollars (over and above all encumbrances and over and above what will pay my just debts and every other sum for which I am now bail or for which I am liable as surety or endorser or otherwise.
And I the said John Morry of Fermeuse for myself make oath and say that I reside at Ferryland and am worth property to the amount of Sixteen hundred dollars (over and above all encumbrances and over and above what will pay my just debts and every other sum for which I am now bail or for which I am liable as surety or endorser or otherwise.

Be it Remembered That on this 7th day of June 1900 in the 64th Year of the Reign of our Sovereign Lady Victoria, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, and in the Year of our Lord One Thousand Nine Hundred personally appeared Patrick Fennely of Fermeuse Planter and John Windsor of Ferryland, JP Planter and John Morry of Fermeuse Trader and did acknowledge themselves to be held and firmly bound to our said Sovereign Lady the Queen, Her Heirs and Successors, in the penal Sum of One thousand six hundred dollars to be had, made and levied on his Goods, Chattels and Effects, jointly and severally, if Default is made in any of the conditions following :---

Now the Condition of this Obligation is such, that if the above bounden Patrick Fenelly as Administrator of the Estate and Effects of Catherine Murphy late of Fermeuse Widow deceased, do make or cause to be made, a just, true, and perfect inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of him the said Patrick Fenelly as such Administrator or to the hands or possession of any other person, or persons, for him and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the 7th day of December next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of her death, or which at any time afterwards shall come into the hands or possession of him the said Patrick Fenelly or to the hands or possession of any other person or persons for him shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of his said Administration, on or before the 7th day of June 1901 which will be in the Year of Our Lord One Thousand nine hundred and one and afterwards from time to time as he shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force and virtue.
