The Petition of Catherine Kough of St. Johns, Spinster

Humbly Sheweth

That Margaret Kough late of St. Johns Spinster died at that place on or about the 10th day of October 1899, intestate.
That at the time of her death the said Margaret Kough was possessed of and entitled to property wihin the Jurisdiction of this Court of the probable value of Two thousand five hundred dollars. That the said Margaret Kough left her surviving one brother and four sisters.
That your Petitioner is the eldest surviving sister of the said deceased.
That no probate of the will or administration of the estate of the said Margaret Kough have been granted by this Honourable Court.
Your petitioner therefore prays that administration to the estate of the said Margaret Kough may be granted to her and as in duty bound she will ever pray &c &c &c

NEWFOUNDLAND
St. Johns   To Wit          I Katherine Kough of St. Johns, Spinster, do swear that I believe that Margaret Kough of St. Johns, aforesaid, Spinster, deceased, died without a Will; and that I will well and truly administer all and every the Goods of the said deceased and pay her debts, so far as her Goods will extend: and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within six months from the date hereof, or when I shall be thereunto lawfully required; and that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased of which she died possessed, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of Two thousand five hundred dollars.

So help me God

WE, Alexander M. Mackay of St. Johns in the Central District of Newfoundland Superintendent of Anglo American Telegraph Company and Philip Cleary of St. Johns in the Central District of Newfoundland Gentleman, severally make oath and say :-
That we are the proposed sureties on behalf of the intended administratrix of the property of Margaret Keough[sic] deceased, in the within bond named, for the faithful administration of the said estate and effects, rights and credits, of the said deceased; and I the said Alexander M. Mackay of St. Johns in the Central District aforesaid, make oath and say that I reside at St. Johns and am worth property to the amount of Five thousand dollars, over and above all encumbrances and over and above what will pay my just debts, and every other sum for which I am now bail, or for which I am liable as surety or endorser or otherwise,
AND I the said Philip Cleary for myself, make oath and say, that I reside at S. Johns and am worth property to the amount of Five thousand dollars, over and above what will pay my just debts, and every other sum for which I am now bail and for which I am liable as surety or endorser or otherwise.

Be it Remembered That on this 8th day of May in the 63rd Year of the Reign of our Sovereign Lady Victoria, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, and in the Year of our Lord One Thousand Nine Hundred personally appeared Katherine Kough of St John's Spinster, Alexander W. Mackay of S. Johns Superintendent of the Anglo American Telegraph Company and Philip Cleary of St. Johns Gentleman and did acknowledge themselves to be held and firmly bound to our said Sovereign Lady the Queen, Her Heirs and Successors, in the penal sum of Five thousand dollars to be had, made and levied on his Goods, Chattels and Effects, jointly and severally, if Default is made in any of the conditions following :---

Now the Condition of this Obligation is such, that if the above bounden Katherine Kough as Administratrix of the Estate and Effects of Margaret Kough late of S. Johns aforesaid, Spinster deceased, do make or cause to be made, a just, true, and perfect inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of her the said Katherine Kough as such Administratrix or to the hands or possession of any other person, or persons, for her and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the 8th day of November next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of her death, or which at any time afterwards shall come into the hands or possession of her the said Katherine Kough or to the hands or possession of any other person or persons for her shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of her said Administration, on or before the 8th day of May which will be in the Year of Our Lord One Thousand nine hundred and one and afterwards from time to time as she shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force and virtue.
