Judges thereof.

The petition of James M. Kent of St. Johns, Barrister

Humbly Sheweth

  1. That Margaret Kent of St. Johns, widow, died there on or about the 4th day of May now present having first duly made and executed her last will and testament of which she appointed your petitioner to be the executer.
  2. That the said testator died possessed of property within the jurisdiction of this honorable Court to the probable value of $7000.00
  3. That the said testator left her surviving as next of kin grandchildren and nephews and nieces.
  4. That no probate or administration has heretofore been granted to any one.

          Your petitioner therefore prays that probate to the said will of the testator be granted to him forth of this Honorable Court and as in duty bound he will ever pray &c &c.

This is to certify that the notice on the face hereof has been posted in the office of the Chief Clerk of the Supreme Court for the space of three days pursuant to O XLVI Sec. 1 of the Judicature Act of 1889.

St. Johns   To Wit          I Donald M. Browning of S. Johns Chief Clerk and Registrar of the Supreme Court make oath and say that on the 20th day of May A.D. One Thousand Eight Hundred Ninety Six I was present and did see Margaret Kent late of S. Johns widow the Testatrix named in the paper writing hereunto annexed marked A, duly sign, publish and declare the said annexed paper writing as and for her last Will and Testament, in my presence and in the presence of Martin W. Furlong the other subscribing witness thereto. That I and said Martin W. Furlong then and there signed our names to such Will as such witnesses, in the presence of the said Testatrix and of each other, and that at the time of the said execution of the said Will the said Testatrix was of sound and disposing mind, memory and understanding, to the best of my knowledge and belief.

This is the paper writing referred to in the annexed affidavit.

This is the last will and testament of me Margaret Kent of St. Johns I hereby revoke all wills by me at any time heretofore made and I appoint James M. Kent of St. Johns Barrister-at-Law the Executor of this my last will and testament and I direct that all my just debts funeral and testamentary expenses be paid as soon as conveniently may be after my decease. I give devise and bequeath unto my niece Mary Donnelly that piece of land together with the dwelling house and shop on Water Street in St. Johns at present occupied by Michael Kelly and it is my will and desire that the said Mary Donnelly shall out [sic] of the rent received for this shall pay the sum of one hundred dollars per year for the saying of masses for the souls of my husband my son and myself. All the rest residue and remainder of my property goods and chattels of every description I give and bequeath to my Executor James M. Kent to hold the same in trust for my grandchildren Margaret, or Rita, Kent, Robert Kent and Mary Kent until the youngest shall attain the age of twenty one years; to devote the income arising from the said property to the education of my grandchildren until the youngest thereof shall attain the said age of twenty one years at which time my said executor shall divide the said property amongst the said grand children or the survivors of them in such manner and in such proportions or shares as to him shall seem best, provided

that my said grandchildren Robert Kent if he so wishes may take the farm and land at Kilbride in lieu of any other share or proportion of the said property. I direct and agree that my Executor James M. Kent shall have and be entitled to receive from and out of my estate and effects the same professional fees (Next line illegible) percentages as if he were not executor or Trustee under this my Will -
In witness whereof I have hereunto set my hand this twentieth day of May one thousand eight hundred and ninety six.

NEWFOUNDLAND
St. Johns   To Wit          I James M. Kent of St. Johns Barrister at Law, do swear that I believe this to be the true Last Will and Testament of Margaret Kent late of St. Johns, aforesaid, Widow, deceased. I do further swear that I will pay all the Debts and Legacies of the said deceased so far as her Goods shall extend, and the law shall bind me, and that I will exhibit a full, true and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when I shall be lawfully called thereto. And I do further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said Margaret Kent deceased, and of which she died possessed, do not, according to the best of my knowledge, judgment and belief, amount to the value of Seven thousand dollars

So help me God
