In the Estate of Catherine Hynes, deceased
We John J. Burke and James Roil ??? of St. Johns severally make oath and say:
That we are the proposed sureties on behalf of the intended administrator with the will annexed of the estate and effects, rights and credits of Catherine Hynes deceased, in the within bond named, for the faithful administration of the said property of the said deceased; and I the said John J. Burke for myself make oath and say: that I am worth property to the amount of one hundred and forty dollars, over and above all incumbrances and over and above what will pay my just debts, and every other sum for which I am now bail, or for which I am liable as surety or endorser or otherwise, And I the said James Roil for myself make oath and say, that I am worth property to the amount of one hundred and forty dollars, over and above what will pay my just debts, and every other sum for which I am now bail and for which I am liable as surety or endorser or otherwise.

Know all Men by these Presents: That we William J. Carroll of St. Johns, an assistant clerk of the Supreme Court, John J. Burke C??? and Tipstaff? of St. Johns aforesaid and James Roil of St. Johns, Bailiff, are jointly and severally bound unto our Sovereign Lady Victoria by the Grace of God, of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, in the sum of Two hundred and forty dollars, to be paid to our said Sovereign Lady the Queen, Her Heirs and Successors for which payment well and truly to be made, we bind ourselves and each of us for the whole, our and each of our executors and administrators, firmly by these presents. Sealed with our seals.

Dated the 4th day of December in the year of our Lord 1900.

The Condition of this obligation is such that if the above named William J. Carroll as administrator of all the estate and effects, rights and credits of Catherine Hynes late of St. Brendans in the Electoral District of Bonavista in the Island of Newfoundland, Spinster deceased, (who died on or about the 18th day of November A.D. 1900) do, when lawfully called on in that behalf, make, or cause to be made, a true and perfect inventory of all and singular the estate and effects, rights and credits of the said deceased, which have or shall come into the hands, possession or knowledge of him the said William J. Carroll or into the hands or possession of any other person or persons for him and the same so made do exhibit, or cause to be exhibited, into the Registry of the Supreme Court of Newfoundland, whenever required by law so to do, and the same estate and effects, rights and credits, and all other estate and effects, rights and credits of the said deceased at the time of his death which at any time after shall come into the hands or possession of him the said William J. Carroll or into the hands or possession of any other person or persons for him, do well and truly administer according to law, that is to say, do pay the debts which the said deceased did owe at his decease, and then the Legacies contained in the said Will annexed to the said Letters of Administration to the said committed, so far as such property will thereunder extend and the law bind him, and further, do make, or cause to be made, a full true and just account of administration within twelve months or sooner if thereunto required, and all the rest and residue of the property shall deliver and pay unto such person or persons as shall be by law entitled thereto; then this obligation to be void and of no effect, or else to remain in full force and virtue.

In the Estate of Catherine Hynes
I, William J. Carroll of St. Johns in the Electoral District of St. Johns in the Island of Newfoundland, Afft Clerk Supreme Court, make oath and say that I believe the paper writing hereto annexed and marked by me to contain the true and original last Will and Testament of Catherine Hynes late of St. Brendans in the Electoral District of Bonavista deceased, and that I will well and faithfully administer the estate and effects of the testator by paying her just debts and the legacies contained in the said Will and distributing the residue of the estate and effects, rights and credits according to law; and that I will exhibit a true, full and perfect inventory of all and singular the estate and effects, rights and credits, and render a just and true account thereof, whenever required by law so to do; that the said deceased at the time of his death, had a fixed place of abode in the Island aforesaid; and that the gross value of the said estate and effects, rights, and credits of the deceased is One hundred and twenty dollars and no more, according to the best of my knowledge, information and belief.

The petition of Michael Reddy of St. Johns Customs Officer

Humbly Sheweth

  1. That Catherine Hynes late of St. Brendans, Bonavista Bay, died at the St. Johns General Hospital on the 18th day of November instant, having made and executed her last will and testament which is hereto annexed marked A, proven in common form upon the oath of John W. White of St. Johns, Barrister at Law one of the subscribing witnesses to same.
  2. That your petitioners wife is a legatee under the said will.
  3. That in and by the said last will and testament, one Catherine Rogers Ladysmaid at Government House was appointed sole executrix thereof.
  4. That the said executrix has renounced as may be seen by the

    annexed paper writing marked "B".
  5. That at the time of the death of deceased, she was possessed of monies deposited in the Newfoundland Savings Bank to the amount of one hundred and twenty dollars
  6. That no probate to any will, nor letters of administration of the estate of said deceased has as yet been granted to any person.
  7. Your petitioner therefore prays that letters of administration cum testament annexo may be granted to a clerk of this Honorable Court or to whomever this Honorable Court may appoint.

In the name of God Amen. I Catherine Hynes of St. Johns, Newfoundland, Domestic Servant, do make this my last will and testament. Firstly, after the payment of all my just, testamentary and funeral expenses are paid, I give, devise and bequeath fourteen dollars to Mrs. Ready, wife of Nicholas Ready, of St. Johns aforesaid for her own use and benefit. Secondly, I give, devise and bequeath unto Annie Maher daughter of William and Clara Maher of St. Johns aforesaid, the sum of ten dollars for her own use and benefit. Thirdly, I give, devise and bequeath unto Madonna Lamb, daughter of Patrick and Josie Lamb of Red Island, Placentia Bay, the sum of ten dollars for her own use and benefit. Fourthly, I give, devise and bequeath unto my niece Johannah Hynes, daughter of Patrick and Mary Hynes of St. Brendans, Bonavista Bay, the sum of twelve dollars. Fifthly, I give, devise and bequeath unto the Reverend Father Battcock of St. Brendans, Roman Catholic priest, the sum of ten dollars for Masses for my soul. Sixthly, I give, devise and bequeath unto Maria Rose, at present of St. Johns and living with her brother Edward Rose, my silver watch for her sole use and benefit. Seventhly, I direct that out of whatever monies my executor may have in his possession belonging to me, after the payment of all the expenses hereinbefore provided for and after the above legacies

are paid, that a suitable head stone be placed on my grave and then, if after payment for the said head stone and incidental expenses, any amount remain in my said executor's possession, I direct that it be paid to my brother, Patrick Hynes of St. Brendans, Bonavista Bay, for his sole use and benefit.
Eightly. I appoint Nicholas ??? of St. John's aforesaid my sole executor.
Eighthly, I appoint Catherine Rogers, at present of St. Johns aforesaid lady'smaid at Government House, my sole executrix of this my last will and testament. I hereby revoke all other testamentary dispositions made by me.
In testimony whereof I have hereunto signed my hand at St. Johns aforesaid this twenty fourth day of November A.D. 1899.

St. John's   To Wit          I John W. White of St. Johns aforesaid, Barrister-at-Law, make oath and say that on the 24th day of November A.D. One Thousand eight hundred and ninety nine I was present and did see Catherine Hynes late of St. Brendans, Bonavista Bay but lately of St. Johns aforesaid, the Testatrix named in the paper writing hereunto annexed, marked A, duly sign, publish and declare the said annexed paper writing as and for her last Will and Testament, in my presence and in the presence of Kate King of St. Johns aforesaid, married woman, the other subscribing witness thereto. That I and said Kate King then and there signed our names to such Will as such witnesses, in the presence of the said Testatrix and of each other and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

Whereas Catherine Hynes late of St. Brendans, Bonavista Bay, who died at the St. Johns General Hospital this city on the 18th day of November instant and having made and executed her last will and testament, bearing date the twenty fourth day of November A.D. 1899 and thereof appointed Catherine Rogers her executrix.
Now I, the said Catherine Rogers of this City, Spinster, do hereby declare that I have not intermeddled in the personal estate and effects of the said deceased and will not hereafter intermeddle therein with the intent to defraud creditors and I do hereby expressly renounce all my right and title to the probate and execution of the said will.
