In the Supreme Court of Newfoundland

To the Honourable the Supreme Court or one of the Honourable Judges thereof.

The petition of the Honourable George Skelton of St. Johns in the said Island Physician.

Humbly Sheweth

  1. That Mary Holden late of St. Johns, aforesaid, widow, died in St. Johns on the          day of March without having previously made and published her last will and testament which is hereto annexed marked "A".
  2. By the said will the testatrix appointed your petitioner and Robert MacKintosh, heretofore of St. Johns aforesaid, draper, executors thereof.
  3. The said Robert MacKintosh has left the Colony and, to the best of your petitioner's belief, will not return.
  4. The value of the estate of the said Mary Holden does not exceed $3500.00
  5. No letters of administration of the said estate or probate of the said will have been granted.

          Your petitioner therefore humbly prays that the said will be admitted to probate and that he be entrusted with the execution thereof, reserving the right of the said Robert MacKintosh, the other executor named in the said will.
          And as in duty bound will pray &c.
          The 29th day of March 1900

I James Stowe of Whitbourne, Newfoundland, Carpenter, make oath and say that on the 28th day of November A.D. One Thousand Eight Hundred and ninety five I was present and did see Mary Holden of St. Johns aforesaid Widow, deceased, the Testatrix named in the paper writing hereunto annexed duly sign publish and declare the said annexed paper writing as and for her last Will and Testament, in my presence and in the presence of William Stowe, of St. Johns in the said Island, carpenter, the other subscribing witness thereto. That I and said William Stowe then and there signed our names to such Will as such witnesses, in the presence of the said Testatrix and of each other, and that at the time of the said execution of the said Will the said Testatrix was of sound and disposing mind, memory and understanding, to the best of my knowledge and belief.

"A"

This is the last will and testament of me, Mary Holden, widow of the late Richard B. Holden, of Saint Johns, Newfoundland, and I revoke all former wills by me made.

  1. I give and bequeath unto my nephew Richard Holden Alcock, son of my late brother, William Alcock, the cottage in which I now reside, situated on Monks Town road, with the land adjoining, also the furniture, beds and bedding in the cottage at my decease.
  2. To my nephew, Albert Alcock, eldest son of my late brother, Wm. Alcock, I give, devise and bequeath the two houses with the land adjoining on Monks Town Road, bounded on the one hand by the premises now occupied by me, and on the other hand by Spry's premises.
  3. I give, devise, and bequeath unto my neice, [sic] Lilian Anstey, daughter of sister Melina Rowsall, deceased, all my clothing and jewelry.
  4. The residue, after the payment of my funeral expenses, and lawful debts, I give, devise and bequeath in equal parts, unto my two nephews described in sections Nos 1 & 2 of this my last will.
  5. I appoint the Honorable George Skelton and Robert MacKintosh Esquire, both of Saint Johns, Executors of this my will.

Dated at Saint Johns this Twenty eighth day of November A.D. eighteen hundred and ninety five.

After three days from date hereof application will be made to the Honourable the Supreme Court or one of the Honourable Judges thereof for probate of the will of Mary Holden, late of St. Johns, N.F. widow, deceased, to be granted to Honourable George Skelton, one of the executors named in the said will.

St Johns   To Wit          I George Skelton of St. Johns, aforesaid physician, do swear that I believe this to be the true Last Will and Testament of Mary Holden late of St. Johns, aforesaid, Widow, deceased. I do further swear that I will pay all the Debts and Legacies of the said deceased so far as her Goods shall extend, and the law shall bind me, and that I will exhibit a full, true and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when I shall be lawfully called thereto. And I do further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased, and of which she died possessed, do not, according to the best of my knowledge, judgment and belief, amount to the value of three thousand five hundred and fifty dollars

So help me God
