St. Pierre-Miquelon
To Wit I John Roach of St. Pierre do swear that I believe this to be the true Last Will and Testament of Michael Hearne of Burin in the Southern District of the Island of Newfoundland, but lately of St. Pierre, Miquelon, Gentleman, deceased. I do further swear that I will pay all the Debts and Legacies of the said deceased so far as Goods shall extend, and the law shall bind me, and that I will exhibit a full, true and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when I shall be lawfully called thereto. And I do further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said Michael Hearne, deceased, and of which he died possessed, do not, according to the best of my knowledge, judgment and belief, amount to the value of Eleven hundred and fifty dollars

The Petition of Peter Walsh of St. Pierre, Miquelon, Shop Keeper and John Roach of the same place, Clerk.
Humbly Sheweth
That Michael Hearne of Burin in the Island of Newfoundland but lately of St. Pierre - Miquelon, Gentleman, died at St. Pierre aforesaid on the twenty first day of July one thousand eight hundred and ninety nine having first made and published his last will and testament which is hereto annexed and which has been duly proved, and that in the said will he named your Petitioners Executors of the same.
That the said Michael Hearn left him surviving his wife Bridget Hearne, a brother, Peter Hearne of Gloucester in the United States of America, a sister, Mary Cooney of Burin aforesaid, and a niece, Ellen Leroix.
That the said Michael Hearn left property at his decease within the jurisdiction of this Honorable Court to the probable value of Seven hundred dollars.
That no probate of any will or letters of administration to the Estate of the said Michael Hearne have been granted or applied for.
Your Petitioners therefore pray that Letters of Probate of the Will of the said Michael Hearne may be granted to them.

To Wit
I Peter Walsh of St. Pierre-Miquelon, make oath and say that on the fourteenth day of April A.D. One Thousand eight hundred and ninety seven at St. Pierre - Miquelon, I was present and did see Michael Hearne late of St. Pierre - Miquelon, the Testator named in the paper writing hereunto annexed marked A, duly sign, (by making his mark) publish and declare the said annexed paper writing as and for his last Will and Testament, in my presence and in the presence of John Roach of St. Pierre, Clerk the other subscribing witness thereto. That I and said John Roach then and there signed our names to such Will as such witnesses, in the presence of the said Testator and of each other. That previously to the said Will being so signed as aforesaid, by the said Testator and the said witnesses, it was read over and approved of by the said Testator in the presence of me and the said John Roach, and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of my knowledge and belief.

In the Name of God Amen
I Michael Hearne of Burin, Newfoundland, now residing at St. Pierre - Miquelon, French Colony, Proprietor being sound in mind, memory and understanding, but considering the uncertainty of this transitory life, do make and publish this my last Will and Testament in the manner and form following, to wit:
First, It is my will and I so order that all my just debts if any, be duly paid and satisfied, as soon as conveniently can be after my decease.
Second, I give and bequeath to the Church of England the sum of six dollars and fifty cents.
Third, I give and bequeath for masses for John Power, formerly merchant of Burin deceased, the sum of Twenty dollars.
Fourth, I give and bequeath to my beloved sister Mary Cooney, now residing at Burin, Newfoundland, the sum of Eighty dollars.
Fifth, I give and bequeath to my beloved brother, Peter Hearne, now residing at ??? U.S.A. the sum of twenty dollars together with all my wearing apparel.
Sixth, I give and bequeath to the Priests of St. Pierre the sum of Twenty dollars for masses to be offered for the benefit of my soul, after my decease.
Seventh, I give and bequeath to my neice [sic] Ellen Leroix (Maiden name Godfr???) the House and garden at present in my occupancy, conditionally that should I die before my ??? beloved Wife, Bridget, that she, my beloved Wife, would have sole control

Seventh, sole control over same during her natural life, but the said Ellen Leroix would require to live in the house and look to my wife while she would be alive. At her death the house and land are to revert to the said Ellen Leroix for her sole use and benefit.
Eighth, I give and bequeath to my ??? beloved wife, Bridget, the residue of whatever belongs to me, both real and personal, not already specified, for her sole use and benefit should she survive me, and for her: at her death to distribute what would be remaining according to her c???es not forgetting if possible to have more names? celebrated for the repose of my soul.
Lastly, I nominate, constitute and appoint Peter Walsh merchant and John Roach, Clerk, both at the present time residents of St. Pierre, to be my Executors of this my Will, and I do declare same to be my last Will and Testament. In witness whereof I have hereunto affixed my hand and seal this Fourteenth day of April one thousand eight hundred and ninety seven.
