Be it Remembered That on this 20th day of December in the 63rd Year of the Reign of our Sovereign Lady Victoria, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, and in the Year of our Lord One Thousand Nine Hundred personally appeared Mary Joseph Gushue of St John's Spinster (fold in document obscuring several words) undertaker and John Byrne also of same place, Cooper and did acknowledge themselves to be held and firmly bound to our said Sovereign Lady the Queen, Her Heirs and Successors, in the penal sum of Two thousand dollars to be had, made and levied on his Goods, Chattels and Effects, jointly and severally, if Default is made in any of the conditions following :---

Now the Condition of this Obligation is such, that if the above bounden Mary Joseph Gushue as Administratrix of the Estate and Effects of Ann Gushue late of St. Johns Widow deceased, do make or cause to be made, a just, true, and perfect inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of her the said Mary Joseph Gushue as such Administratrix or to the hands or possession of any other person, or persons, for her and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the 20th day of June next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of her death, or which at any time afterwards shall come into the hands or possession of her the said Mary Joseph Gushue or to the hands or possession of any other person or persons for her shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of her said Administration, on or before the 20th day of December which will be in the Year of Our Lord One Thousand nine hundred and           and afterwards from time to time as she shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force and virtue.

NEWFOUNDLAND
St. Johns To Wit          I Mary Joseph Gushue of St. Johns aforesaid Spinster do swear that I believe that Ann Gushue late of St. Johns aforesaid Widow deceased, died with a Will; and that I will well and truly administer all and every the Goods of the said deceased and pay her debts, so far as her Goods will extend: and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within six months from the date hereof, or when I shall be thereunto lawfully required; and that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased of which she died possessed, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of One thousand one hundred dollars.

I Albert Lec Berteau of St. Johns Solicitor make oath and say that on the twenty seventh day of October A.D. One Thousand Eight Hundred and four [sic] I was present and did see Ann Gushue late of St. Johns, Married woman, the Testatrix named in the paper writing hereunto annexed, marked A, duly sign, publish and declare the said annexed paper writing as and for her last Will and Testament, in my presence and in the presence of John Sn???s the other subscribing witness thereto. That I and said John Sn???s then and there signed our names to such Will as such witnesses, in the presence of the said Testatrix and of each other, and that at the time of the said execution of the said Will the said Testatrix was of sound and disposing mind, memory and understanding, to the best of my knowledge and belief.

"A"

This is the last Will and Testament of me Ann Gushue of Saint Johns in the Island of Newfoundland - Married Woman.
First I direct that my funeral and Testamentary expenses shall be first paid out of my general Estate.
Second, I give devise and bequeath to my beloved husband Frank Gushue the Dwelling House owned by me situate on Gower Street in the town of Saint Johns together with all and singular the household goods furniture and effects of every description therein contained to hold the same to him during the term of his natural life, and after his decease I will and bequeath the said dwelling house household goods, furniture and effects to wit - goods, furniture and effects to my three daughters, namely Mary Joseph, Annie and Agnes Mary as the survivor or survivors of them to be their separate and absolute Estate in equal proportions free from the control of any present or future husband or husbands.
Third, It is my desire that the said dwelling house shall not be disposed of or in any way encumbered, but that the same shall remain for the benefit of my said daughters after the decease of my said husband.

Fourth, I hereby appoint my said husband Frank Gushue to be the sole Executor of this my Will and hereby revoke all former Wills and testamentary writings by me at any time heretofore made and declare this to be my true last Will and Testament.
Dated at Saint Johns this 27th day of October in the year of our Lord eighteen hundred and ninety four.

The petition of Mary Joseph Gushue of St. Johns Spinster

Humbly Sheweth

  1. That Ann Gushue mother of your petitioner died at St. Johns on or about the 20th day of January 1895 having previously made her last will and testament which is hereto annexed marked "A" and proven upon the oath of A. Lec. Berteau, one of the subscribing witnesses thereto.
  2. That by her said last will and testament the said Ann Gushue appointed Frank Gushue, her husband, sole executor thereof.
  3. That the said Frank Gushue died on or about the 6th day of October 1898 leaving him surviving two sons and three daughters.
  4. That the said three daughters of whom one is your petitioner are legatees under the will of the said Ann Gushue and with the exception of your petitioner are minors.
  5. That the said Ann Gushue was at the time of her death possessed of property consisting of a dwelling house and furniture situate in St. Johns aforesaid of the probable value of One thousand dollars.
  6. That no probate of the said will or administration to the estate of the said Ann Gushue has been granted by this Honorable Court.

          Your petitioner therefore prays that administration

with the will annexed to the estate of the said Ann Gushue may be granted to her and as in duty bound she will ever pray &c &c &c.
