NEWFOUNDLAND
Hr. Grace To Wit We George A. Gosse, Martin Gosse, and John Sheppard of Spaniards Bay Planter, do swear that we believe this to be the true Last Will and Testament of Robert Gosse late of Spaniards Bay aforesaid, Planter, we do further swear that we will pay all the Debts and Legacies of the said deceased so far as his Goods shall extend, and the law shall bind me, and that we will exhibit a full, true and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when we shall be lawfully called thereto. And we do further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said Robert Gosse, deceased, and of which he died possessed, do not, according to the best of our knowledge, judgment and belief, amount to the value of Four thousand five hundred dollars

I Robert Gosse planter in the Harbor of Spaniards Bay in Conception Bay, Newfoundland being of pearfct [sic] mind and memory of my body and knowing that it is appointed for all men once to die do make and ordain this my last will and Testament that is to say princepley [sic] and first of all I give to Eliza my beloved Wife Sixteen hundred dollars with my dwelling house and all out houses with all my land and all my furniture and Cattal [sic] to be hirs [sic] during her natural life providing always that she hold the name of the late Robert Gosse Widow but immediately after marriage or death the aforesaid money and property is to become my two sons namely George Alexander Gosse and Martin Gosse to be equeley [sic] divided between them the Western part of said land to be George A. Gosse and the Eastern part with dowling [sic] house & out houses on said land setuated [sic] at Nort [sic] side of mane [sic] line of Rode [sic] with half the said land at ?ec side and half store that is now on said land the other half to be my son George A. Gosse the store and water side to be for both thare [sic] use
I give to my two sons George A. Gosse and Martin Gosse all the money that is laft [sic] after paying all Bills should there be any to be equelay [sic] divided between them I also give them all my fishing property and Schooner hare [sic] at Spaniards Bay and at Horse Harbor Labrador to be equely [sic] devided [sic] between them.

If my Wife should remain the Widow of the late Robert Gosse of Robert She might make a will and give or? money to ether [sic] of hir [sic] two sons namely George A. Gosse or Martin Gosse I will not controle [sic] hir [sic] in that part but the land is to be equely devided between tham both. [sic]
And this being my my [sic] last will and testament all the above ?? namd [sic] Shall be guided and directed by my three Executors namly [sic] George A. Gosse and Martin Gosse & John Sheppard of John I hareby set my hand and seal This Sixteent [sic] day of September one thousand Eight hundred Ninty [sic] seven

I Robert Gosse of Spaniards Bay Fisherman make oath and say that on the Sixteenth day of September A.D. One Thousand Eight Hundred and ninety seven I was present and did see Robert Gosse late of Spaniards Bay the Testator named in the paper writing hereunto annexed marked A, duly sign, publish and declare the said annexed paper writing as and for his last Will and Testament, in my presence and in the presence of George A. Gosse and Martin Gosse of the same place Planters the other subscribing witness thereto. That I and said George A. Gosse and Martin Gosse then and there signed our names to such Will as such witnesses, in the presence of the said Testator and of each other, and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of my knowledge and belief.

TO THE HONOURABLE THE SUPREME COURT OR ONE OF THE HONOURABLE THE JUDGES THEREOF.
The petition of Martin Gosse of Spaniards Bay Planter,
HUMBLY SHEWETH
- That Robert Gosse late of Spaniards Bay aforesaid, planter, deceased, died at that place on the nineteenth day of October 1899, having previously made and executed his last Will and Testament hereto annexed duly proven.
- That said testator appointed as Executors to the said last will and testament George A. Gosse, John Sheppard and your petitioner.
- That said testator was possessed at the time of his death of property of the probable value of Four thousand five hundred dollars.
- That no Probate or administration has been granted to any Will or to the Estate of said deceased.
- That said testator left him surviving his widow Eliza Gosse, two sons, George A. Gosse and your petitioner.
Your petitioner therefore prays that Probate to the said last Will and
Testament may be granted to the Executors in the said Will named.
