AFFIDAVIT

In the Supreme Court of Newfoundland
----------------

NEWFOUNDLAND
St. Johns To Wit         I Arthur W. Martin of St. John's aforesaid, Accountant, do swear that I believe this to be the true Last Will and Testament of Isaac French formerly of Bay Roberts but late of St. Johns aforesaid, fisherman. I do further swear that I will pay all the Debts and Legacies of the said deceased so far as his Goods shall extend, and the law shall bind me, and that I will exhibit a full, true and perfect Inventory of all and every the Goods, Rights and Credits of the deceased, together with a just and true account into the Registry of the Supreme Court of Newfoundland, when I shall be lawfully called thereto. And I do further swear that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said Isaac French, deceased, and of which he died possessed, do not, according to the best of my knowledge, judgment and belief, amount to the value of one thousand dollars.

So help me God

Three days from the date hereof application will be made to the Honorable the Supreme Court of Newfoundland or to one of the Honorable the Judges thereof for Letters of Probate of the last Will and Testament of Isaac French Formerly of Bay Roberts, Conception Bay but late of St. Johns, deceased, to be granted to Arthur W. Martin of St. Johns Post Office Official the Executor in the said Will named.

St. John's To Wit
I Arthur W. Martin of St. Johns aforesaid Post Office Official make oath and say that on the ninth day of May  A.D. One Thousand Eight Hundred and ninety one? at St. Johns I was present and did see Isaac French late of St. Johns aforesaid, formerly of Bay Roberts the Testator named in the paper writing hereunto annexed, marked A, duly sign (by making his mark), publish and declare the said annexed paper writing as and for his last Will and Testament, in my presence and in the presence of William John French, Mary J. French, and Fanny J. Mercer the other subscribing witnesses thereto. That I and said William John French, Mary J. French, and Fanny J. Mercer then and there signed our names to such Will as such witnesses, and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of Deponent's knowledge and belief.

TO THE HONOURABLE THE SUPREME COURT OR ONE OF THE HONOURABLE THE JUDGES THEREOF.

The petition of Arthur W. Martin of St. Johns, Post Office official,

Humbly sheweth

That Isaac French, late of St. Johns but formerly of Bay Roberts, died at St. Johns on the 23rd day of February last, having previously made and executed as and for his last Will and Testament the paper writing hereto annexed marked "A", wherein he appointed your Petitioner executor thereof.
That the said Isaac French left him surviving as next of kin his wife Jemima French and five children namely, Fannie Mercer of Bay Roberts, wife of Samuel Mercer, William John French of Toronto in the Dominion of Canada, Sarah Crane, of St. Johns, wife of Stanley Crane, Elizabeth Cook of St. Johns, Wife of Albert Cook and Mary Jemima Cox of Toronto, aforesaid, wife of John Cox.
That the probable value of the estate and effects of the said Isaac Mercer is $1000.00.
No probate of any Will or Administration of the Estate of the said Isaac French has been at any time granted by your Honourable Court.
         Your Petitioner therefore prays that your Honourable Court, or one of the Honourable the Judges thereof will be pleased to grant to him Letters of Probate of the said last Will and Testament of the said Isaac French deceased.
And as in duty bound your Petitioner will ever pray.

Feeling that my life is in the hands of my Heavenly Father and that he may perhaps shortly call me to Himself
I Isaac French formerly of Bay Roberts, Conception Bay but now of St. Johns, do by this my Last, and only will, give and bequeath to my beloved wife, Mary Jemima French, the sum of $ 439.91 Cash to my Credit on the Books of the firm of Baine Johnston & Co of this city to be used by her for her maintenance and support, as she may find it necessary - also I devise to her this House, Lazy Bank [sic] Road with all its appurtenances, its effects, furniture, and contents to be used by her for her comfort as long as

She may need it and at my decease she shall have perfect and absolute right to dispose of it as she may think best.
I desire and devise to my son William John, all the land with the dwelling house, store, and stable and their contents now in his possession situated at Bay Roberts and can only say I feel he will good [sic] to his mother in her declining years.
Also it is my wish that the land situated in Bay Roberts near and west of the Roman Catholic Chapel shall be and continue in the possession of my wife, Mary Jemima French until such time either before or at her death she may dispose of the same as she desires to do and I do now and hereby appoint Mr. Arthur W. Martin of St. Johns as my Executor to see that the aforementioned conditions are carried out.
