NEWFOUNDLAND
St. Johns To Wit:          I Thomas Evans of St. John's aforesaid do swear that I believe that Robert Evans late of St. John's aforesaid, Fisherman, deceased, died with a Will; and that I will well and truly administer all and every the Goods of the said deceased and pay his debts, so far as his Goods will extend: and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within six months from the date hereof, or when I shall be thereunto lawfully required; and that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased of which he died possessed, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of                      dollars.

So help me God

Be it Remembered That on this 15th day of January in the 63rd Year of the Reign of our Sovereign Lady Victoria, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, and in the Year of our Lord One Thousand Nine Hundred personally appeared Thomas Evans of St. Johns, Carpenter, Albert Soper of same place, Grocer's assistant and Ma??? Beaton Auctioneer and did acknowledge themselves to be held and firmly bound to our said Sovereign Lady the Queen, Her Heirs and Successors, in the penal Sum of Eight hundred dollars to be had, made and levied on his Goods, Chattels and Effects, jointly and severally, if Default is made in any of the conditions following :---

Now the Condition of this Obligation is such, that if the above bounden Thomas Evans as Administrator of the Estate and Effects of Robert Evans late of St. Johns, Fisherman, deceased, do make or cause to be made, a just, true, and perfect inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of him the said Thomas Evans as such Administrator or to the hands or possession of any other person, or persons, for him and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the 15th day of July next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come into the hands or possession of him the said Thomas Evans or to the hands or possession of any other person or persons for him shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of his said Administration, on or before the 15th day of January which will be in the Year of Our Lord One Thousand nine hundred and afterwards from time to time as he shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force and virtue.

Three days from the date hereof application will be made to the Honourable the Supreme Court or one of the Honourable the Judges thereof for letters of administration C.T.A. to the Estate of Robert Evans late of St. Johns fisherman, deceased, to be granted to Thomas Evans of the same place, carpenter, son of said deceased.

Know ye that I Robert Evans of St. Johns,Newfoundland at Spencer Street No thirty two Do hereby give grant Deliver make over After my Death unto my three sons William James and Robert Evans to have and to hold henceforth for the term stated on the lease all that Piece [sic] or parcel of land Situated on Spencer Street No 32 measuring in Front twenty two feet one inch Rearage one hundred Feet From Street Bounded on the north By land Belonging to Henry taylor [sic] on the South By land ocupied [sic] by Charles Bond this is to Be Handed over unto my Sons as Soon as I am Dead This tenth Day of September in Saint Johns Newfoundland this is my last Will and Testament                              Signed By Robert Evans

I James Cook of St. Johns aforesaid Carpenter make oath and say that on the Tenth day of September A.D. One Thousand Eight Hundred and Ninety Six I was present and did see Robert Evans late of St. Johns Newfoundland aforesaid Fisherman, the Testator named in the paper writing hereunto annexed marked A, duly sign, publish and declare the said annexed paper writing as and for his last Will and Testament, in my presence and in the presence of Henry Taylor of St. Johns aforesaid Labourer the other subscribing witness thereto. That I and said Henry Taylor  then and there signed our names to such Will as such witnesses, in the presence of the said Testator and of each other, and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of my knowledge and belief.

TO THE HONOURABLE THE SUPREME COURT OR ONE OF THE HONOURABLE THE JUDGES THEREOF.

The petition of Robert Evans of St. Johns P???, humbly sheweth

  1. That your petitioner's father Robert Evans of St. Johns aforesaid, fisherman, died on the 30th day of September 1896, having made and published his last Will and Testament, hereto annexed duly proven.
  2. That said testator left him surviving four sons, namely, Thomas, James, William and your petitioner, and four daughters, namely, Elizabeth, wife of James Evans, Mary, wife of William Garland, Emma, wife of Edward Penny, and Amelia, wife of Robert Dean.
  3. That said testator was possessed at the time of his death of property of the probable value of $400.00.
  4. That no executor was appointed by the said testator to his said last Will and Testament.

          Your petitioner therefore prays that Administration cum testamento annexo to the said said Estate be granted to Thomas Evans of St. Johns aforesaid, Carpenter.
          Dated at St. Johns aforesaid this 20th day of December A.D. 1899.
