In the Estate of Richard Dyer, late of Logy Bay in the District of St. Johns Fisherman deceased, I Patrick Dyer of Logy Bay of St. Johns East make oath and say, That I believe the paper writing hereto annexed and marked by me to contain the true and original last Will and Testament of Richard Dyer late of Logy Bay in the Electoral District of St. Johns East, deceased: That I am the Executrix therein named and that I will well and faithfully administer the estate and effects of the testator by paying his just debts and the legacies contained in his Will so far as the same shall thereto extend and the law bind me, and by distributing the residue (if any) of the estate according to law: and that I will exhibit under oath a true, full and perfect inventory of all and singular the estate and effects, rights and credits, of the testator and render a just and true account thereof whenever required by law so to do: that the testator died at Boston in the United States of America aforesaid on the Seventh day of February One thousand eight hundred ninety-seven and that the gross value of the estate and effects, rights and credits of the said testator is Seven hundred dollars, and no more, according to the best of my knowledge, information and belief.

Three days from the date hereof application will be made to the Honorable the Supreme Court or to one of the Judges thereof for Probate to the Will of Richard Dyer late of St. Johns, Fisherman, de-ceased, to be granted to Patrick Dyer the Executor in the said Will named.
          Dated St. Johns this 8th day of June AD. 1900.

To the Honourable the Supreme Court or one of the Honourable the Judges thereof.

The Petition of Patrick Dyer of Logy Bay in the District of Saint Johns, Farmer.

HUMBLY SHEWETH

  1. That Richard Dyer late of Saint Johns aforesaid, Fisherman, died on the 7th day of February A.D. 1897, having made and published his last Will and Testament hereto annexed marked "A".
  2. That the deceased was possessed at the time of his death of property of the value of seven hundred dollars.
  3. That Testator left him surviving him his widow, Margaret Dyer, and one daughter Ellen Earle at present residing in Boston in the United States of America and one son, George Dyer, residing in the same place aforesaid since deceased.
  4. That by the said last Will and Testament the said Testator appointed your Petitioner to be Executor thereof.
  5. That no probate or Administration has been granted to the estate of the said deceased out of this Honourable Court.

          YOUR PETITIONER therefore prays that Probate of the said Will be granted to him.
          AND AS IN DUTY BOUND HE WILL EVER PRAY.
          Dated at Saint Johns this nineteenth day of June A.D. 1900.

I Patrick Dyer of Logy Bay Road in the District of Saint Johns, Farmer, make oath and say

  1. That the contents of the foregoing Petition are just, correct and true
  2. That to the best of my knowledge and belief, the above is a just and true inventory and valuation of the said deceased at the time of his death, as far as I can at present ascertain.

This is the last Will and Testament of me Richard Dyer of St. Johns in the Island of Newfoundland fisherman and I hereby revoke all former wills by me made.

  1. I appoint Patrick Dyer of St. Johns Farmer as my Executor.
  2. I give and bequeath unto my son George Dyer at present of Boston in the United States of America Seaman the front Western half of that piece or parcel of land at Logy Bay and known as "The Black Bird Nest" farm.
  3. I give and bequeath unto my daughter Ellen Earle, at present of Boston in the United States of America, Widow, the back, or Eastern half, of that piece or parcel of land at Logy Bay and known at "The Bird Nest Farm".
  4. I also give and bequeath unto my said son George Dyer all my fishing room premises situate on the South side of Dyers Cove at Logy Bay aforesaid.
  5. I give and bequeath unto my daughter Maude Earle all that piece or parcel of land situate at Logy Bay and known as the "Marsh."
  6. I give and bequeath unto my grand daughter, Minnie Earle all that piece or parcel of land situate at Logy Bay and known as "The Old Gardens."
  7. I give and bequeath unto my Grandson, George Earle, all that piece or parcel of land

    situate at Logy Bay and known as "The Back Cove fishing premises."
  8. I give and bequeath to my beloved wife Margaret Dyer for and during her natural life and on her death to my grand daughters Maude Earle and Minnie Earle my interest in the dwelling house situate on Longs Hill ??? the town of St. Johns

          In witness whereof I have hereunto set my hand this Eighth day of September Anno Domini One thousand eight hundred and ninety six.

          To Wit
I Sydney D. Blandford of St. Johns aforesaid Solicitor make oath and say that on the Eighth day of September A.D. One Thousand Eight Hundred and ninety-six I was present and did see Richard Dyer late of Saint Johns, aforesaid, the Testator named in the paper writing hereunto annexed marked A, duly sign, publish and declare the said annexed paper writing as and for his last Will and Testament, in my presence and in the presence of James P. McLoughlan, the other subscribing witness thereto. That I and said James P. McLoughlan, then and there signed our names to such Will as such witnesses, in the presence of the said Testator and of each other, and that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory and understanding, to the best of my knowledge and belief.
