In the Estate of David Dunphy late of Torbay Fisherman deceased, I Denis Dooley of St. Johns in the Central District of Newfoundland make oath and say:
that I am the proposed surety on behalf of the intended administratrix of the property of David Dunphy deceased, in the within bond named for the faithful administration of the said property, of the said deceased; and I the said Denis Dooley of St. Johns aforesaid make oath and say that I reside at St. Johns and am worth property to the amount of two hundred dollars, over and above all encumbrances and over and above what will pay my just debts, and every other sum for which I am now bail, or for which I am liable as surety or endorser or otherwise,

Be it Remembered That on this 1st day of May in the 63rd Year of the Reign of our Sovereign Lady Victoria, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, &c, and in the Year of our Lord One Thousand Nine Hundred

personally appeared Dora Dunphy of Torbay Widow and Denis Dooley of St John's Butcher, and did acknowledge themselves to be held and firmly bound to our said Sovereign Lady the Queen, Her Heirs and Successors, in the penal sum of Two hundred dollars to be had, made and levied on his Goods, Chattels and Effects, jointly and severally, if Default is made in any of the conditions following :---

Now the Condition of this Obligation is such, that if the above bounden Dora Dunphy as Administratrix of the Estate and Effects of David Dunphy late of Torbay in the Central District, Fisherman, deceased, do make or cause to be made, a just, true, and perfect inventory of all and singular the Goods, Credits and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of her the said Dora Dunphy as such Administratrix or to the hands or possession of any other person, or persons, for her and the same so made do exhibit, or cause to be exhibited, in the Supreme Court of Newfoundland, at or before the 1st day of November next ensuing the date hereof; and the said Goods, Chattels, Credits and Effects, and all other the Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come into the hands or possession of her the said Administratrix or to the hands or possession of any other person or persons for her shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true account of her said Administration, on or before the 1st day of April which will be in the Year of Our Lord One Thousand nine hundred and afterwards from time to time as she shall be lawfully required. And all the rest, residue, and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in due course of Administration, or in such a manner as the said Court shall direct; then this obligation to be void and of no effect, or else to be and remain in full force and virtue.

NEWFOUNDLAND
St. Johns To Wit:          I Dora Dunphy of Torbay in the District of St. Johns Widow, do swear that I believe that David Dunphy late of Torbay aforesaid, Fisherman, deceased, died without a Will; and that I will well and truly administer all and every the Goods of the said deceased and pay his debts, so far as his Goods will extend: and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased, and render a true account of my Administration into the Registry of the said Court, within six months from the date hereof, or when I shall be thereunto lawfully required; and that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased of which he died possessed, within the jurisdiction of this Court, do not, according to the best of my knowledge, judgment and belief, amount to the value of Nine hundred dollars.

TO THE HONOURABLE THE SUPREME COURT OF ONE OF THE HONOURABLE THE JUDGES THEREOF.

THE PETITION of Dora Dunphy of Torbay in the District of St. Johns East in the Island of Newfoundland, Widow, by her Solicitor, Charles O'Neill Conroy

Humbly Sheweth that

  1. David Dunphy, late of Torbay, aforesaid, Fisherman, deceased, died at the said place on or about the 10th day of January last past, intestate.
  2. The said deceased left him surviving his widow Dora, your Petitioner, and five children, namely Margaret Waterman (formerly Dunphy), Patrick Dunphy, Annie Dunphy, Mary Dunphy, and James Dunphy, of which said children, the said Margaret, Patrick, Annie, and Mary are of age, and the said James Dunphy is a minor aged 16.
  3. The said deceased, at the time of his death, was possessed of property of the probable value of Nine hundred dollars, consisting of a farm situate at Torbay aforesaid and the sum of $100.00 in cash.
  4. No administration to the estate of the said David Dunphy has been granted forth of your Honourable Court to anyone.

          YOUR PETITIONER THEREFORE PRAYS that your Honourable Court or your Lordship may be pleased to grant to her Letters of administration to the estate of the said deceased.
          AND, as in duty bound, your Petitioner will ever pray etc. etc.
